The core fault is having individuals on the same PR ballot as parties.

@IECSouthAfrica partly recognised this in June, when they (correctly) said that #Proportionality requires separate PR and #Constituency ballots.

But, they fail to follow their own / Image
reasoning in respect of Provincial Legislatures.

They propose a PR ballot for the #NationalAssembly, and sub-national regional ballots, which allow #IndependentCandidates to stand.

But with no way to do the same for prov legislatures, they just IGNORE the constitutional fault.
The @IECSouthAfrica further undermine the (correct) reasoning of their proposal by using both the regional AND the PR ballots for the overall PR calculations.

Essentially, they preserve some of the disproportionality of the regional ballots.

The Minister is now discussing responses by Senior Counsel on behalf of the Department.

He stresses their observation that submissions ARE being taken into account.
The Minister discusses the introduction of the extra ballot for the #NationalAssembly, using the original content-less justification for the extra ballot.

He ignores the #Proportionality implications raised by @IECSouthAfrica in their second submission.
The Minister discusses the response of Senior counsel to the #Vacancy question.

The argument is that the proposal best reflects the will of the voters (as against the idea of a running mate).

This ignores the bias in favour of the largest party.

Sy Mamabolo of @IECSouthAfrica addresses the core issue of #Proportionality.

He makes the FALSE and MISLEADING point that, as perfect proportionality is not achievable, the degree of disproportionality in the Bill is acceptable.

- district size
- electoral formula
