#BREAKING Judge Dana Sabraw Finds 11 of 18 parents deported w/o their kids under last year's #FamilySeparation policy can return to the U.S. to seek asylum.

More than 400 parents were deported without their kids last year. Many parents opted not to be reunited w/ their kids in the hopes they could successfully pursue asylum on their own. Some kids were reunited w/ their families back home.

@OIGatHHS .@HHSgov faced unique challenges in addressing the mental health needs of separated children, who suffered fear, abandonment, post-traumatic stress, & anxiety. Some cried uncontrollably from “acute grief.”

Of course they did – the Trump Admin tore these kids from their parents.
@OIGatHHS @HHSGov Stunningly, this report reveals that ORR staff did not know how to seek approval or consent to treat traumatized children with psychotropic medication. The lack of clarity on this process is unacceptable and disturbing.

First, let’s recall that last June thousands of us did participate in marches and rallies to express opposition to #familyseparation and zero tolerance as tools of US immigration policy. 2/
Last year’s efforts motivated litigation and action by Dem Senators to try to achieve family reunification. Mitch McConnell is the reason that bills to address the problem have not been enacted. In other words, we need to flip the Senate blue in 2020. 3/

The Dignity for Detained Immigrants Act was originally introduced in 2018, but HR 2415 is back in 2019, via @RepJayapal, @RepAdamSmith & in the Senate, @SenBooker has introduced S 1243.

@RepJayapal @RepAdamSmith @SenBooker HR 2415 has 8 sections, but 2 are basically "this is the bill's name" and "yep, that was the bill," so we'll look at the other 6.

Sec2 says DHS detention facilities need to adopt standards within a year of the bill's passage, no less strict than the ABA set forth in 2012.

NEW: two families are suing the Trump administration for harm suffered as a result of #FamilySeparation. Both fathers were forcibly separated from their children for weeks, and both children allegedly suffered abuse while in US govt custody.
According to the filing:
One father APF (Dad1) & his son OPD, 7, were separated between May 15 & 21, 2018 after crossing into Arizona. They claim to be fleeing persecution in Guatemala and sought medical attention for OPD, who'd had surgery when he was 6 for a heart condition.
In filing:
Dad1 says CBP agent who encountered him and his son called them "stupid f***ing animals" and screamed at them. Dad1 says he repeatedly asked for help for his sick son back at the station, "but the agents told him he was not allowed to talk or ask questions."

Keeping families together is not an excuse for detention. Let’s be very clear. Immigration detention is a cruel and unnecessary practice. Innocent children should never be used as a propaganda tool.
Zero Tolerance was used as a terror tactic to keep out asylum seeking families. The youngest victims of this policy were infants, some just a few months old. DHS and the Trump administration are hiding behind the rhetoric of national security.
These families come here fleeing persecution. They are met with razor wire and heavily armed CBP officials. Children are not a threat to our borders. The US government is attempting to dehumanize and criminalize these families. #FamilySeparation

House Judiciary Cmte holds 10am hearing on the Trump administration's #FamilySeparation policy. Officials from Border Patrol, ICE, DOJ's immigration courts, & HHS - including Scott Lloyd, who used to oversee the care/custody of migrant kids, will testify. Follow here for updates
From 2017-2018 Lloyd ran the Office of Refugee Resettlement (ORR) in HHS. ORR is responsible for the care of unaccompanied children in US custody. His tenure @ ORR overlapped with the Trump administration's Zero Tolerance/Family Separation policy.
Before working for ORR, Lloyd worked for an anti-abortion organization. During his time at ORR, he blocked multiple abortion requests from young women in his custody, including one minor who was raped. A federal judge overruled him.

As we all know - the ONLY PRESSURED REUNIFICATIONS that have happened since zero-tolerance have been driven by the @ACLU's lawsuit against the government, but the "class" (as in the individuals eligible for relief from that lawsuit pressure) is limited to parents. 3/

The decision to pardon Arpaio was a prelude of what was/is to come. Remember that Arpaio was charged w/contempt of court for failing to follow the Court's order that his office cease racial profiling. Trump was signaling that contempt of court was fine for HIS SIDE. /2

Jenny Lisette Flores, 15, fled civil war in El Salvador In 1985. When she was apprehended at the US-Mexico border she was held for months in an #immigration detention facility together with unrelated adults. /2

Pursuant to Trump's #FamilySeparation Executive Order, @TheJusticeDept asked a federal court to let the government out of the Flores settlement. This binding settlement is the only law preventing the horrific caging of children apprehended by ICE. Here's what you should know:
The DOJ "motion," asks for two "narrow" exceptions to the Flores settlement:

First, to be able to detain families together.
Second, to make family jails exempt from licensing requirements, which govern the minimum standards of care in these jails.
Why?

So that our government can more efficiently detain families together in preparation for deportation.

Again: This is to make deportation easier, faster, cheaper, more efficient.
