Unbelievable! USCIS delayed the #H2B rule for 55 days past employer's start dates. Then tells them all that their labor certifications are "out of date" if the start date was more than 45 days ago, forcing them to redo the whole process. Wonder why we've got illegal immigration?
I'm certain that #H2B employers will do this, but it is absolutely ridiculous and unfair to employers that are trying to follow the law. They met all the requirements. They did everything right, and now USCIS says they have to redo it b/c the agency messed up. Unbelievable.
USCIS says every employer under this rule will have to prove "irreparable harm" if they don't get visas and that the visas will help preserve US workers jobs. Yet it is arbitrarily capping the number of visas at 1/3 the number Congress allowed. It doesn't even try to justify it

My new long paper explains the H-2B visa—one of the most regulatory complex visa programs in America and how to improve it. Every year including 2020 and 2021, the #H2B visa cap (last updated in 1990) is filled, leaving thousands of jobs unfilled cato.org/publications/p…
Employers must undertake costly and lengthy recruitment efforts and offer inflated wages, but they almost never find U.S. workers to fill the positions. The program has helped greatly reduce illegal immigration from Mexico. Here are some major findings.
H2B mandated wages have risen at twice the rate of wages overall and DOL continues to certify as unfilled by U.S. workers and ever greater number of jobs each year

New! @CatoInstitute published today 30 short essays by 15 authors including some of America's leading immigration law experts urging Biden to go beyond reversing Trump's cuts & act to streamline & expand legal #immigration w/ agency action #BuildBackBetter cato.org/publications/s…
My coauthors & I sped after Nov 7 to compile the most rigorous but brief & readable cases for specific exec actions. Thanks @IraKurzban @CyrusMehta @WStock215 @AllyBolour @DavidKubat @AngeloPaparelli @SYaleLoehr @ASGvisalaw @GSiskind @MLaCorte_ @AILANational (& Amy/Scott/Lindsay)
Our list (1) is solely #legalimmigration & (2) goes past all Trump actions. We feel reversing them is not enough. Obviously, we didn’t touch on every issue, but went for novel or high impact ideas. This list sets the bar high but much more needs to be done by the admin & Congress

1/ A few quick notes on Trump's desperate move today to suspend most non-immigrant labor visas, starting with this:

It's a proclamation, not an executive order.

Is there a difference? Not really! Does it matter? No. Trump sure does love his proclamations though!
2/ First, the suspension of new immigrant visas (the basis for greencards) from April is extended, bc nothing says "we love immigrants, so long as they do it the right way!" like slamming the door on the "right way" for people who have already been waiting for months, if not yrs
3/ This thing is in effect until the end of 2020, at which point the administration is delusionally "assuming the conclusion of the economic contraction" even as we're facing down the barrel of a second wave, record mass unemployment, and an economy in freefall

Winter is coming...preceded by the Fall 2018 Unified Regulatory Agenda from @DHSgov. Once again, semi-annually, it's time to see what new #immigration actions we might find buried in this list of rulemaking plans that's hiding in plain sight? 1/ reginfo.gov/public/do/eAge…
Let's start with @DHSgov proposals that didn't appear in the prior regulatory agenda this past spring. (These are all draft rules that haven't been published yet, and won't take effect for months or years, after a full public notice-and-comment process.) 2/
Two new actions affecting #asylum-seekers, tightening "credible fear" determinations and eligibility for work permits, both in the name of deterrence... 3/
