BREAKING: The 5th Circuit has ruled on #DACA, largely upholding a lower court ruling finding the policy unlawful.

It allows renewals to continue temporarily & has sent the case back to the lower court to consider @POTUS's new DACA regulation, which goes into effect on 10/31.
To be clear: This decision doesn't change who can currently apply for or renew DACA for now.

And at the same time, immigrant youth CANNOT continue to live under unceasing politicized attacks on DACA, and thus, their lives.

This painful uncertainty must end. #HomeisHere
DACA is a successful and commonsense policy that has transformed lives, improved our economy, and strengthened our nation.

It is legally and morally right, but it was always meant to be temporary.

Nothing has changed today. DACA renewals remain open to folks with current DACA. Folks with DACA can apply for advanced parole. And first-time DACA applications, sadly, can be accepted but not adjudicated. Today was just an important set of court papers being filed. ⚖️📰 /2
This case involves TX (& a handful of other states) who sued to end DACA claiming it is illegal. They won in district court in July 2021, and the case is now up on appeal to the 5th Circuit. The 5th circuit now has all the papers before it & could issue its ruling any day. /3

The recent attention in the media to the pressing issue of #DocumentedDreamers gives us an opportunity to take a bigger view of immigration issues. The issue of kids aging-out is an unintended though not unforeseeable consequence of massive #GCBacklogs.🧵 👇 1/9
Fundamentally, this is a demand-supply and allocation issue. The number of #GC annually given out has not changed meaningfully since 1990. Meanwhile the US economy and labor market today are completely different from back then. 2/9
On top of this supply issue of #GC is the fact that their allocation is not equitable. How long you wait in line, usually boils down to the country you were born in. Not on skills, education, work experience, duration of stay in the US or contribution to the economy. 3/9

The Biden DOJ is speaking now and is discussing the Friday announcement that DHS would begin a rulemaking on #DACA and saying at minimum it will make substantive changes to the program.
First question from the Judge to DOJ: when is that rule making going to happen, anticipating that Texas will say "judge we have been waiting years for a decision."

Some Friday afternoon #DACA news. @TheJusticeDept just filed a notice before J. Hanen in the case brought by Texas challenging the legality of the DACA program. In that notice, DOJ says DHS intends to issue a Notice of Proposed Rulemaking proposing a new regulation on DACA /1
A status conference is set for March 30 @11 am CT in Houston where the parties will discuss what happens next. Just as a recap, the parties here are: Texas & other states trying to end the DACA program; @MALDEF & @NewJerseyOAG who have intervened to defend DACA & DOJ. /2

--The DACA program must return to how it was before the effort by the Trump administration's effort to end the program on Sept. 5, 2017. #HomeIsHere

Here are my take aways from the the govt brief filed in the Batalla #DACA case now. As a recap, the Court ruled on Nov. 14 that the Wolf memo gutting DACA valid was issued without legal authority. The question in these briefs is what the court should require the govt to do. /1
THIS JUMPED OUT AT ME. 65,800 is the number of 1-year DACA grants and work permits issued since the unlawful Wolf memo. That's 65,800 people who got 1-year grants unlawfully and now should get 2-year grants /2
Also, the federal government agrees that the court should now set aside the Wolf memo & that relief should run nationwide to the class certified of all DACA recipients & DACA eligible individuals. AND, the federal govt agrees this means DACA should return to its 2012 version. /3

The administration is flouting immigration-related court orders left and right. As of yesterday, migrant children remain in ICE custody despite a federal court order to release them, and today, it has demonstrated flagrant violation of its legal obligations to DREAMers.
This open defiance undermines the admin’s claims that it values law + order. It has repeatedly shown its disdain for vulnerable immigrant children and the legal obligations that protect them. When politicians show us who they really are, it is our responsibility to believe them.
It falls on each and every American who stands for welcome to name racism and xenophobia when they see them, and to take action in defense of our neighbors. DREAMers are every bit as American as us, and it is well past time we enshrine in law that their #HomeIsHere.
