Jose spent 888 days in ICE prisons before he was freed last April. He fled Guatemala as a child after being shot in the stomach and left for dead. He was ordered deported by Judge Tara Naselow in 2017 when he was just 17 y/o and unrepresented. (thread)
By chance, I met him shortly after & we began long fight to right this wrong. Over the next 2.5+ years I visited Jose in 4 ICE prisons & told him many times that we weren’t going to give up. Sometimes I cried leaving worried I was creating false hope while he continued to suffer.
And then today, a LA Superior Crt Judge made orders finding that Jose was abused, abandoned & neglected by his parents & that it is in his best interests to remain in the US. With this, we are able to apply for his SIJS visa & are now one (huge) step closer to keeping him safe.

Success! After a year of hard work, ImmDef's PCR Project successfully vacated our client Max's only deportable conviction. Without this conviction Max is no longer deportable and his immigration proceedings will end.

THREAD 1/6 Image
Max can now live in peace with his partner and continue watching his grandchildren grow. His deportation would have caused a lot of pain, not just for him but for all the people that love him and depend on him.

Max has been living in the U.S. for 40 years and is a father, uncle, and grandfather to many. In 2014, Max’s world was turned upside down when he was put in deportation proceedings. Max was brought to US by his parents at age 12 in 1972.

Much needed #goodnews! After such a difficult week we are elated to share some happy news: Client A's immigration proceedings were terminated last week and he was released the next day! (THREAD 1/5) ImageImage
This is especially significant because had our Staff Attorney, Karina Ramos, not been by his side to advocate for him, he would have been transferred to an adult detention facility when he turns 18 next month. (THREAD 2/5)
In light of #COVID-19, to be free at this time, even if it means he has to quarantine with his cousin during his first week of freedom, is a difference of life or death. Thousands are still vulnerable to COVID-19 while in ICE prisons. @ICEgov REFUSES to release them(THREAD 3/5)

@DOJ_EOIR's latest:
“EOIR further memorializes the following policies in order to encourage immigration judges to resolve as many cases as practicable without the need for a hearing and, thus, to minimize contact among individuals in immigration proceedings. (THREAD 1/4)
Resolve as many cases practicable without the need for a hearing? Is this really a time to push judges to deport people? This is an abomination of #dueprocess. As much as we need to adjust to protect public health through this crisis, it should not be at the demise of justice.
The latest from @DOJ_EOIR gives judges carte blanche authority to not hold hearings. They are using a public health crisis to ramp up the deportation machine and roll it right over #dueprocess rights. #ImmDef wont let this happen without a fight. #LaLuchaContinua #DueProcess4all

On the Ground in Adelanto Detention Facility during #COVID19: Eyewitness account from our Directing Atty Lisa Okamoto. Our attys visited clients @ ADF today in the midst of a pandemic. @ICEgov refuses to free them despite their inability to protect them. #ParoleThemAll (THREAD)
#covid_19 creates the perfect storm for ICE to violate their civil rights & we are doing everything in our power to stop them.
Upon Arrival: ADF is screening all lawyers in the lobby. Family visits discont'd, so its eerily quiet except for the guards. Lawyers must take temp & fill out form asking if any flu-like symptoms in last 14 days, traveled internationally or had close contact with anyone who has.

Director of Legal Services, Joyce Noche gave a powerful speech during MPP press conference. She shared a story of one of her clients, an 18-year-old named Yolanda who had been separated from her pregnant sister when the pair arrived at the border to ask for asylum.
“She was immediately targeted upon return [to Mex], stalked and harassed by people who saw her for what she was — a vulnerable girl with no one to protect her who had been thrown into the streets… I have never worried as much about my client’s safety as I do about Yolanda.”"

Our CBI (bit.ly/2E7H10O) Managing Attorney @CargioliM and @ImmFamTogether worked hard to secure Jose's entry into the U.S.

CBP doesn't understand legal docs so they turned our client away who was 1 of 15 in #MPP history free on bond. Our Managing Attorney @CargioliM pushed back, "I told him, with all due respect, that’s the problem with MPP." - Learn more & join the fight. immdef.org

She is one out of 50k. Since Jan 2019, more than 50k asylum-seekers have been forced into the streets of dangerous border cities as part of the #migrantpersecutionprotocols. She is just one of the 50k desperate for help as they face a system completely stacked against them. Image
Yesterday she and her mom attended our clinic in Mexicali where we filled out their asylum applications so they have something to file when they return to court. ImmDef's Cross-Border Initiative is a lifeline giving families like hers a fighting chance at safety and protection. Image
Under the #migrantpersecutionprotocols, border courts are overwhelmed. Since Jan, cities like San Diego have seen new cases jump from ~200 to more than 2,000 a month. Judges lacking judicial independence are under pressure to violate due process in order to keep their jobs.
