HUGE defeat in the House of Lords on the #InternalMarketBill - we believe the biggest since Lords reform in 1999

395 peers opposed the government, just 169 supported, a margin of 226. Biggest prior defeat was by 191 on the Counter-Terrorism Bill in 2008

The vote was on the 'regret' motion proposed by former Lord Chief Justice Lord Judge.

To regret "that Part 5 of the bill contains provisions which, if enacted, would undermine the rule of law and damage the reputation of the United Kingdom.”

The clergy have decided to meddle in temporal matters today, specifically the #InternalMarketBill with some Good Friday Agreement grifting thrown in for good measure.

Unfortunately for them the bill in questions doesn’t support such claims.

The specific bit of the GFA they claim is under threat by the #InternalMarketBill is s 6(2) committing the government to incorporate the European Convention on Human Rights into #NorthernIreland law which was subsequently done via the Human Rights Act 1998

Utter condemnation from @HLConstitution of the Government's #InternalMarketBill.

The AG & Lord Chancellor should be ashamed, as should a Prime Minister and Foreign Sec who claim to be committed to both the union & to Britain's reputation abroad. #ruleoflaw #devolution
This conclusion as to the casual disregard for the #ruleoflaw in Britain is utterly damning of Johnson’s government.

It damages not only our crucial work abroad as part of an international order but also the very foundations of our democracy, and societial consent for our norms.
Our system has Law Officers to ensure that we abide by the rule of law. These aren’t political games. These are essential offices to maintain the norms by which our democratic society functions, by advising the govt & maintaining public confidence. And yet...

There are currently 63 EU infringement proceedings active against France for breaches of, among others, environmental, money laundering and waste regulations

This is the exact same type of legal action now launched against UK for the #InternalMarketBill

2/ Michael Keating begins, the internal market is, in many ways, a way of replicating what exists to faciliate the European single market. Two options are available: a single standard or principle of mutual recognition
3/ No internal market covers everything, how do we determine the exceptions? The EU operates under a very broad principle, allowing governments to override for public policy objectives. The UK Bill is much more narrowly defined.

The fullest defence yet of #InternalMarketBill (contingent powers only; Brandon Lewis wrong) was given by Lord Keen at the start of today's @LordsEUCom Justice meeting. Video here, parliamentlive.tv/Event/Index/e2… transcript in a few days. A court commitment stopped me attending, sadly.
He took the same line as at today's PNQ hansard.parliament.uk/lords/2020-09-…, but had more time to set it out. In short #IMBill gives UK powers that may be needed to respond to a fundamental breach by EU of the WA or to exercise our rights under Art 16 of the NI Protocol or Art 62 VCLT.
Those conditions are not specified in the Bill (which is far broader than Keen's explanation could justify), and there was no evidence that HMG's fears are realistic or that this is a wise negotiating strategy. But intellectually, an improvement on previous defences (a low bar).

The #InternalMarketBill is a legal, political and geopolitical wrecking ball, that is crashing through the devolution settlement with one swing, the rule of law with another, & the UK’s international reputation as the pendulum takes it through for a final pass.
The main purpose of the Bill is to ensure barriers to trade do not emerge within the UK after it has left the single market and customs union. This is the right thing to do.
I recall Spanish colleagues telling me that the overarching framework of EU law was critical in making Spain’s internal market function properly and the UK is no different. So there is work to be done.
