A lot of folks in my TL are busily badmouthing the #JCPA, the legislation stalled in Congress that would force Google and FB to pay news orgs.

I have a few thoughts, and also a request.

First, the request: Do some reporting. 1/
Australia has a similar system, called the Media Bargaining Code. I spent a few months there researching it and spoke to more than 20 news managers, at companies ranging from News Corp to the Guardian to small weeklies.

Most of them praised the Code for enabling them to expand staff or avoid layoffs. I checked in with a few of them last month, and they hadn't budged. They want it to continue.

The #JCPA is a pro-monopoly bill, allowing news publishers to form a cartel and demand payment for any links to their content. It’s must-carry, and must-pay, no matter how extreme the content. That's why 20+ civil society and library groups opposed.

1/ The JCPA has changed since our letter, and since Cruz derailed it with a hostile amendment at markup. It *might* get marked up again this AM.

2/ The first notable change to #JCPA actually happened the evening before the last markup. Recall that the bill allows publishers to join together to negotiate the terms and conditions by which platforms "access" their content. But "access" was originally left undefined.
3/ That was a problem, as it could have amounted to imposed must-carry obligations on platforms. But last week's manager's amendment inserted a definition of "access" -- "acquiring, crawling, or indexing content." Image

The answer is no, they won't. We need rules to stop targeted ads, and lots of antitrust law to break up big tech. This is one piece. And in Australia, the #JCPA-like law forced big tech to bargain fairly with the news and now journalist there is flourishing.
What is actually wild is how @mattfwood and his colleagues are weighing in on a bill about advertising when they have literally no idea how any of these markets work, and simply oppose for-profit news on principle.
And look, I don't mind those who oppose for-profit news and wish that America only had a public interest news ecosystem. I disagree with that premise. But if that's what you think, don't attack a bill that will redress advertising bargaining imbalances under false pretenses.

A few things to keep in mind as we head into this:

1. Funding journalism is an incredibly complex problem, and it's not a new one. Journalism has *always* struggled with funding. This is a huge problem that needs to be addressed, but it's also not unique to the current moment.
2. Media consolidation is a HUGE part of the crisis of local journalism.

3. This is ultimately about asserting that news outlets should be able to control what third parties link to them. Self-help options exist; they claim those aren't enough. They want a copyright extension.

The premise of #JCPAct is that News Corp, Fox News, all the biggest peddlers of disinfo in news, need a special law to link up and collude more with Facebook, the biggest peddler of disinfo online—using their power to crush local journalism in the process.
