The Rajasthan High Court has denied police protection to a couple of a widow and a married man whose first marriage was still subsisting and valid.

The woman had lost her husband and was since living with her 3 children. The man had been living separately from his wife. They got married earlier in June.
Refusing to grant the petitioners any police protection, the court noted that as the man was already married and had not obtained divorce, his first marriage was still subsisting. As such, even though the petitioner woman was a widow, her marriage with the married man was void.
The Punjab & Haryana High Court recently observed that, if two adult people are in a live-in relationship with each other, even though they are already married to someone else, would be no offence.
