Just received word that Judge Torres and the attorneys are returning from their tour of #MDCBrooklyn and will reconvene here shortly.

So, instead of watching the #SOTU, I will be live-tweeting the court hearing - if there's overlap.

ICYMI, earlier today:…
On that subject: My colleague @BBuchman_CNS will be live-tweeting #SOTU, if you're following that.

Watch both of our feeds tonight, to see two very different states of our union.
(General bustle in the gallery of an otherwise empty courtroom, save for spectators.)

Good morning from New York.

I'll be live-tweeting a hearing today at 11 a.m. in the case of #MDCBrooklyn inmate Jose Segura-Genao, whose attorney first complained about the power outage there on Jan. 31.

Here's a snippet from the letter.

Later that day, Mr. Segura-Genao's attorney filed a follow-up letter informing the judge of other cases related to the MDC outages. Here's the story of Dino Sanchez, whose attorney's affidavit is included in the linked file.…
U.S. District Judge Analisa Torres ordered two MDC officials to testify today: June Bencebi and Anthony Sanon.

She also allowed the defense to call witnesses about the conditions at MDC.

“If the conditions of confinement at MDC are as represented on plaintiff’s submissions, there can be little question that such conditions are constitutionally intolerable.”

Judge’s written order, after today’s TRO.

Background, via @amandaottaway and me…
The firm representing the Federal Defenders touts the order as an “important first step” until they seek an injunction and court-appointed special master in the #MDCBrooklyn suit
"The court is not only authorized but obligated to ensure that individuals confined in our federal institutions are provided with access to attorneys, as guaranteed by the Constitution. If not the courts, then who?"

The DOJ released this statement this morning about #MDCBrooklyn, now saying that heat, power and hot water were restored last night at 6:30 pm.
A few notes:

* This statement flatly contradicts the one by MDC warden’s spox in the Times denying those outages.

* It’s corroborated by tweets/footage of lights going on inside the jail around that time last night.

* More info likely to come out at court hearing tomorrow.
Timestamped just before 6:30 pm last night.

Heading back to #MDCBrooklyn now. Hearing that family members of those incarcerated have been pepper sprayed. Joining colleagues bringing our legal pads & pens, as well as our phones, to document. 25 minutes away. More soon.
From my colleague just leaving: “The organizers are doing a great job & there’s a mic now - lots of community organizers & formerly incarcerated people are speaking. Please don’t let the pepper spray scare you away - the numbers out there are good but each supporter matters.”
“If you’re still cold and need heat, bang on those windows!”

“If you need medication, bang on those windows!!”

They’re still banging. Loudly.
