...and enrollees who AREN'T currently eligible for subsidies would see savings of up to $17,000/year or more.

📣 Expanded #ACA subsidies under the #AmRescuePlan are to be *retroactive* to the beginning of 2021, which means *current* enrollees are supposed to receive the extra subsidies dating back to Jan 1! They may be applied to future premiums *or* as part of a tax refund next year. 3/

🚨 REMINDER: The U.S. Supreme Court is scheduled to release one or more opinions TOMORROW MORNING. This may include the fate of the Affordable Care Act. 1/

Oral argument *seemed* to go well for the #ACA last November, and the consensus opinion is that #SCOTUS will either throw the case out or, at worst, order the mandate language stricken while leaving the rest intact...which would be mildly irritating but otherwise fine. 2/
HOWEVER, there's 4 *other* possible rulings:
1. They kick it back down to the district court again.
2. They strike down guaranteed issue & community rating only.
3. They strike down most of the law but leave oddball provisions in place.
4. They kill the entire law. 3/

🚨 Here we go again: The decision on the #TexasFoldEm lawsuit deciding the fate of the #ACA *may* (or may not) be on the agenda a week from today.
AS A REMINDER, Congress still has one shot to #MootTheSuit before SCOTUS issues their decision...but at this point it seems like everyone involved is taking it as a given that the law will be upheld after all.

Praying "everyone" is correct. 🙏

Note: This doesn't mean the #TexasFoldEm case is over; all it means is that the DoJ is now formally DEFENDING the #ACA instead of siding with the GOP plaintiffs.

The case was already heard by SCOTUS in November. The decision is expected sometime this spring or summer.
The other option is for Dems to #MootTheSuit via simple legislation to either:

1. ⬆️ the mandate penalty back to $1 or more
2. Formally state that the mandate can be ✂️
3.❌ the mandate language itself:

🚨 The Sword of Damocles continues to dangle over the #ACA: Democrats STILL have ONE CHANCE to #MootTheSuit ahead of the #SCOTUS ruling:

There was a chance the Supreme Court would either save *or* kill the #ACA this morning as part of several decisions announced...but the #TexasFoldEm case turned out not to be among those.

That means the ACA will likely survive at least until sometime this spring/summer. 2/
The good news is this means Congress still has time to #MootTheSuit. There's three possible ways to resolve the issue before SCOTUS issues their decision:

1. ⬆️ the penalty to $1 or more
2. Clarify that the mandate can be✂️
3. ❌ the mandate language itself

After #SCOTUS heard oral argument in the absurd GOP-brought, GOP-blessed #TexasFoldEm lawsuit to strike down the #ACA last November, the assumption was that there's no way that they would issue their opinion any earlier than April - June. 2/
HOWEVER, both @ShermanCourt and @AHoweBlogger have noted that the #SCOTUS website indicates that they're scheduled to issue opinions on several cases "argued in the fall and/or winter" tomorrow (Wednesday) morning.

It's unknown which cases this may include. 3/

This one is a bit confusing at the moment. HC.gov is re-launching Open Enrollment for the uninsured from 2/15 - 5/15 across 36 states; other states have...varying deadlines (see link for updates)
2. MAKE SURE YOU ENROLL IN AN #ACA-COMPLIANT PLAN!
Make sure to enroll using an official #ACA exchange *or* an authorized partner which *only* offers ACA-compliant policies!

Before 11/08/16, I was secretly planning on shutting down (or at least mothballing) ACASignups.net as soon as the 4th #ACA Open Enrollment period was over. Traffic had been gradually dropping off as people got used to the ACA & it started to fade from the headlines.
My official day job as a website developer had suffered. What was supposed to have been a 6-month hobby in my spare time had turned into a full-time job, and I had lost web clients along the way. I figured it would be time to wind down ACA Signups & refocus on my web business.

Currently, #ACA enrollees pay between 2-10% of their income in premiums up to 400% of the federal poverty line (FPL)...but if you earn more than that (around $51K/yr if you're single; around $105K/yr for a family of four), you receive *no* assistance & have to pay full price. 3/

I've tried to patiently explain that M4All would also include an individual mandate penalty. It's called "pay your fucking taxes or you get busted by the IRS."
Irony: As terrible as the GOP's ACA "replacement" plans were, THEY STILL HAD AN INDIVIDUAL MANDATE PENALTY of one sort or another.

One added a 30% premium surcharge for a full year if you went without coverage & wanted it back. Another added a 6-month lockout period.
Of course, when every one of their replacement plans failed, what was the one thing they *did* eliminate? The ACA's mandate penalty.

Result? Unsubsudized premiums jumped around $580/year per individual market enrollee. Not nearly as much as expected, but not chump change either.

The @HouseDemocrats, @SenateDems, @JoeBiden & @KamalaHarris can #MootTheSuit and #SaveTheACA by passing any one of the following 3 simple, 1-paragraph bills:

1. ⬆️ the mandate penalty above $0
2. Clarify that the mandate can be ✂️
3. ❌ the mandate language itself
In the House, any could be done easily.

In the Senate, the 1st could be done via budget reconciliation; the 2nd or 3rd would need 50 votes+VP w/no filibuster *or* 60 with it.

It could be easily tacked onto a larger bill...but that bill would have to be passed & signed QUICKLY.
