The lawyer who successfully argued that the detention of some men under SOE was unlawful shared with @djmillerJA this evening that his client was being held on an allegation that he killed a man who was very much alive. Let me repeat the police alleged a man was dead, who wasn’t
They held on to a man for this alleged dead man’s murder. The victim was very much alive & operating a car wash in Westmoreland. The police denied this to the tribunal and the tribunal sided with the police and the “perpetrator” held. IT. GETS. WORSE.
The crime officer for Westmoreland checks & proves that the “dead man” is very much live, and this information isn’t sent to the Tribunal. So a young man sits incarcerated for over 100 days, for a crime that wasn’t committed.

We need to begin thinking critically about what prisons actually do to our society and not what we think/want them to do.

We've consistently used prisons to escape any responsibility of addressing our systemic issues of racism, classism, and other forms of oppression.
We have to begin by (re)imagining what we truly want as our goal when someone commits a 'crime' and ensure that our justice system aligns with what we want.
How can we take seriously new strategies of restorative rather than exclusively punitive justice?
The INDECOM report on #NoelChambers, who was detained for four decades without trial, is an indicator that something is wrong beyond the "efficiency" of the justice system. There is something wrong with our desire for prisons to relieve us of thinking about issues & punish.

You have to be of sound mind, however. Otherwise, you are #UnfitToPlead.

If you are unfit, you are locked away until you were lucid and stable enough to make a choice.
