The #Nigerian judiciary is often said to be "The last hope of the Common (Wo)Man". It's a venue for deliberative decision making & authoritative statement of the standards that govern us all. The quality of decisions coming from there in recent times is now cause for concern....
4 recent decisions illustrate a worrying pattern of perverse reasoning from #Nigerian courts & tribunals. In Jan 2019, the Code of Conduct Tribunal, a body controlled by the executive arm, issued an ex-parte order to suspend the Chief Justice of #Nigeria

A lot of attention is rightly paid to the seriousness of charges against Chief Justice #Onnoghen. But precisely because of that, they deserved dispassionate due process. Now, few ppl will accord them serious weight because of the deep deficiency of process

NOW THAT ATIKU HAS DECIDED TO GO TO COURT, I FULLY SUPPORT HIM
Much has been made about my position on @atiku approaching the court to challenge the result of the February 23, Presidential Election. I have been misquoted to that he will lose at the Election Tribunal.
Thread...
That is far from the truth. I meant he will face an uphill task, given the circumstances of challenging the Election results. My initial decision to charge @atiku not to go to court is based on the fact that President Muhammadu Buhari has subverted the Supreme Court...
By the removal of CJ #onnoghen and the appointment of the Acting CJN. My perception is that we need to resolve the status of the Supreme Court. I wonder what is taking the NJC so long. I am also worried about the historical precedent, as no petition on Presidential Election.....

1/ A carelessly incurred fine, effectively ignoring a surging ISWAP, the CCB’s sudden impotence, and a judicial bailout for an under fire ruling party, Nigeria has become the land where the unnecessary is king.
2/ The drama between @MobilePunch and @CCBNigeria represents the latest indication of the current administration’s selective commitment to the rule of law.
3/ The irony of @CCBNigeria who responded to a letter against CJN #Onnoghen - an official who is no favourite of @MBuhari - in a matter of hours while ignoring a legal request for information that could potentially tar @AsoRock’s leading lights is inescapable.

Last Friday, @MBuhari suspended the Chief Justice of On Friday, 25 January, 2019, President Muhammadu Buhari suspended the Chief Justice of @SupremeCourtNg, Justice Walter #Onnoghen, pending the completion of his trial at @CCBNigeria's tribunal.
@MBuhari immediately swore in Justice Ibrahim Tanko Mohammed as the acting CJN.

In a swift reaction, @NigBarAssoc issued a statement unequivocally rejecting and condemning “this attempted coup against the Nigerian Judiciary” and fixed an emergency meeting for today.
@SPNigeria & and Speaker of @HouseNGR, both condemned @NGRPresident’s move.

It is worthy to note that to legally remove the CJN, the other 2 arms of govt, @AsoRock & @nassnigeria have to be in agreement on the issue, so a 2/3 majority is needed at @NGRSenate.

President Muhammadu Buhari`s suspension of the Chief Justice of Nigeria, Justice Walter Onnoghen is the most brazen assault on Nigeria`s constitutional history.

Thread
The President has obviously not listened to the advice of the Hon. Attorney General of the Federation or the Attorney General of the Federation has misadvised him or both.
President Buhari claims that the suspension of the Chief Justice Onnoghen is pending the determination of the Code of Conduct Tribunal, CCT. This is simply not true. The CCT itself adjourned proceedings in respect of Justice #Onnoghen `s matter.

The gist of the story & clear intent to work to pre-determined outcome in the CJN #Onnoghen matter is buried in dates. The petition against CJN Onnoghen was dated 7 January. It was actually stamped into the office of the Chairman of the Code of Conduct Bureau (CCB) on 9 January
On the same day, 9 Jan, according to the ex-parte order of the Code of Conduct Tribunal (CCT), which only became public yesterday, after the purported suspension of CJN #Onnoghen, the @Buhari administration filed a petition with the CCT for his removal
It's quite clear that there was no time between the receipt of the petition by the CCB & the referral to the CCT. Under the law, the obligation to verify claims made in asset declaration forms belongs exclusively to the CCB. This cld not have bn done before charges were filed.

This tragedy surrounding #Onnoghen did not unfold in a vacuum. The law may be technical sometimes but it is important to note that it gives cognisance to the surrounding facts and circumstances - bit.ly/2Hv8WfO
n this case, we must never forget how this started.

A private citizen with close ties to @MBuhari obtained the CJN’s 2014 and 2016 asset declaration forms.

This is clear conflict of interest, and asking how Dennis Aghanya obtained the CJN’s asset declaration is relevant.
The speed at which things moved after Aghanya’s involvement, within 5 days, investigation was done, charges were brought. Again, asking how is relevant.

Since then the focus has desperately been on getting the CJN out of the way, just as election tribunals are to be constituted.

1/ #Nigeria's judiciary is under the spotlight yet again, for decidedly unsavoury reasons.
2/ Barring any drastic change of plans, the CJN, Honourable Justice Walter #Onnoghen will be arraigned by @CCBNigeria this morning on 6 counts of alleged false asset declarations.
3/ The charge, based on a petition to @CCBNigeria by a self-styled anti-corruption group led by @cpcnatpubsec, a former official of @MBuhari’s defunct political party, CPC, alleges that #Onnoghen maintains multiple undeclared foreign-denominated accounts.
