🧵Interesting morning. At 10 a.m., #SCOTUS decided Brownback v. King, the @IJ case I argued Nov. 9. The Court gave the gov't a *formal win* by reversing the 6th Cir. on a jurisdictional issue, but a *substantive loss* by declining to end the case. 1/

As we argued, the most important issue in this case is whether the FTCA's judgment bar can be applied to different claims brought in the same lawsuit. We say no, the gov't says yes. The Supreme Court held that the Sixth Circuit will have to decide that issue first. 2/
In a powerful concurrence, Justice Sotomayor then highlighted the arguments we made for why--as a matter of centuries of common law and statutory interpretation--a dismissal against one claim cannot preclude another claim in the same lawsuit. 3/

Here's a little history. Qualified immunity was created by the Supreme Court in 1967, to shield police and other government officers from damages liability when they acted in "good faith." But in 1982, the Court said it should protect officers unless...
... they violated "clearly established law." Today the Supreme Court has instructed lower courts that they must dismiss damages claims against officers unless there is a prior opinion in which a court held virtually identical facts to be unconstitutional.

My heart breaks for every injustice meted out to the vulnerable in society by the police either by our legacy police officers, The special anti robbery squad (SARS) or any other archetype of the tactical unit of the police force.
A critical examination of the incidents as well as information I'm privy to shows this is way beyond just the SARS unit as the campaign suggests abnitio in 2017.
It seemed like we would turn a corner with the work that led to the new laws (Police Trust Fund and Police Act 2020).
and all our behind-the-scene advocacy efforts for the institution, its members and we the people, but the reality of young people as being expressed - from tech guys to entertainment professional shows that there more work to be done.

1/ In the wake of George Floyd’s murder, something that hasn’t gotten a lot of attention is the role of medical examiners/coroners in investigating deaths that happen in police custody:
2/ @jfeldman_epi has done some really important research that shows that a MAJORITY of deaths in police custody from a police-related injury were misclassified by death investigators in 2015.
3/ Some of this may be due to the subjectivity of death investigations but also: 28 states still have coroners, who are often ELECTED and DON’T have to have medical training. 30 STATES don’t require autopsy reports to be done by pathologists.

2/ . The body-cam finally is released to reveal that the 6 officers was not trying figure out how wake this black man up, how to get his attention, but rather, get ready to “snatch his ass [out of the car]”, & “If he reaches for it, you know what to do”. Basically, shoot him!
3/ Full disclosure, a gun was sitting on this black’s man lap. But does that mean illegal? No. And if this man was asleep, worrying about him grabbing it before the six police officers who already have guns in their hands in ready position is reasonable? Probably not!
