Our latest in the #PrivacyOfThePeople series is out now, and this time we've focused on digital lending apps (both 'legal' and 'illegal') — the information they collect, the lack of regulation, and how the PDP Bill comes into the picture.

Thread 👇🏽 1/5
internetfreedom.in/privacyofthepe…
After the pandemic began, illegal digital lending apps started offering unsecured loans to desperate borrowers. Interest rates (60-100%) and tenures (7-10 days) varied widely — no KYC. Extensive data was collected from phones & borrowers were harassed. 2/5

Although digital lending apps fill a genuine market gap by offering credit to borrowers traditionally left out by financial institutions due to a lack of formal credit history, this may come at the expense of privacy and consumer welfare in India.

Are you aware of how much information you share with dating apps? #PrivacyOfThePeople

These applications don’t have the best track record when it comes to data leaks.

And let's be real: this information can be really sensitive and personal. #PrivacyOfThePeople

India's incoming data laws need our serious attention NOW.

The Joint Parliamentary Committee is all set to table their comments within the next few days, & you deserve to know: What are its glaring issues? How can we make it better? 🧵 1/n #MonsoonSession

Is India's incoming data law secure? Is it enough? Does it really protect you?

At IFF, we dived into them through #StartFromScratch #DataProtectionTop10 #PrivacyOfThePeople, where we analysed the Bill and looked at how they would affect you — as someone under its purview. 2/n
Now, the recommendations of the JPC will probably be considered, and the Bill itself may be passed. We're keeping our eyes peeled! But the story isn't over just yet.

Due to the cabinet reshuffle, multiple positions lie vacant in the JPC, including that of the chairperson! 3/n

In our weekly series #PrivacyOfThePeople, the IFF team critically looks at India's incoming data law and how well (or not) it protects vulnerable populations, and the data you constantly log in.

This week, we're looking at your healthcare data👇🏾 1/n

internetfreedom.in/will-indias-he…
So what exactly is healthcare data?

There are two types — personal, relating to your health conditions, & non-personal, where data is aggregated + anonymised. And there's an increasing interest in collecting this — for supposed effectiveness & better resource utilisation! 2/n
With the amount of health data India generates, protecting them is an uphill battle! In fact, between 2009 and 2020, 3,705 healthcare data breaches of 500 or more records have been reported.

So we have to ask: Is the incoming data law up to the task? 3/n

Does India's incoming data protection law actually protect you on social media?

Not really. We need to cover all kinds of data (not just personal) and we definitely need stronger data protection regulations. #PrivacyOfThePeople

You generate an enormous amount of data merely by engaging with social media. Platforms track every click! And in the absence of data protection regulation, your data may most likely end up with anyone — from a researcher to an advertiser to a foreign intelligence agency. (2/n)
Although the incoming data law is a step in the right direction, rights-based data protection means that users are given certain essential rights against data fiduciaries.

As it stands, your rights to be forgotten, correction, erasure, & data portability can all be denied! (3/n)

IFF suggests that all #AgriStack implementation be halted till extensive consultations with farmers have been carried out. Issues exist with data localisation & protection, federalism, user rights, and there's a need for public investment.

Robust data standards are also very much a necessity. What is the AgriStack project? Last year, we released an explainer. We have continued to engage with the issue through letters, analyses, & disseminating relevant information. #PrivacyOfThePeople (2/n)

#AgriStack has also been receiving public attention, especially around:

a. The lack of consultations with farmers and farmers’ organisations.
b. The potential threat of the erosion of privacy and data exploitation.
c. The fear of a ‘corporate takeover’ of agriculture. (3/n)

Privacy is a right, not a privilege. So why are ASHA workers, who ensure the welfare of rural & marginalised communities, facing mass surveillance? India's incoming data law has a lot to do with these rights violations. A thread on #PrivacyOfThePeople.

internetfreedom.in/privacyofthepe…
Accredited Social Health Activists (ASHA) look over a thousand families in 1 administrative unit, going door-to-door to increase awareness on healthcare, sanitation, etc. in rural communities. Usually, ASHAs belong to the same marginalised groups.

Battling the issues caused by COVID, ASHA workers now have to resist State surveillance too. A Mobile Device Management app (MDM 360) has been forcefully installed on their phones to track their locations, 'efficiency,' add/delete information, etc.
