Hello, we are @GuneetKaurAhuja and @aimanjkhan. Today, we examine how UAPA became a handy tool for the party in power to manipulate investigations into mass violence incidents, protect real perpetrators, quell peaceful protests & persecute protestors & other rights defenders. 1/n
This is an old sinister strategy, used by the party in power after 2002 anti-Muslim pogrom, as well. Then, investigations were botched to protect perpetrators & POTA used to further persecute Muslim community & silence those demanding accountability. 2/n

Similar strategies have been used by the party in power post targeted mass violence in #BhimaKoregaon & #Delhi. The aim of perpetrators in both episodes was to violently attack & shut peaceful assertions of constitutional equality by minorities & marginalized. 3/n

Governments in India have routinely used the suspension of regular procedure under the UAPA to bypass human rights. The annual crime statistics compiled by the National Crime Record Bureau every year present a compelling illustration.2/n
Since 2018, charges under the UAPA are being documented under “Offences against State” in the crime statistics. In 2018, even though the police filed the highest numbers of cases under UAPA out of all offenses against the state, it had the lowest rate of charge- sheeting. 3/n

As a 1st step, let's recap some of the wide discretionary powers that investigating agencies get, to decide who will be targeted by UAPA. It is totally at the whim of the government on which organization is banned & which is not. 2/n

1/6. It is a systematic means to curb & witch-hunt those critical of the ruling dispensation of the time. A brief bio of those incarcerated under it proves this point: lawyers, journalists, poet, social activist, students.

2/6. UAPA does this by allowing for long periods of police custody, and a much longer period of custody without chargesheet. For 6 months, an accused doesn't even know what he is accused of.

3/6. It is said bail is the rule & jail is the exception. But UAPA makes it almost impossible to secure bail. A person keeps languishing in jail for durations without anything being proved against him/her. Example, lawyer Sudha Bharadwaj in jail for the last 2 yrs. #RepealUAPA
