Just in: Federal/provincial/territorial information and privacy commissioners (including B.C.'s @McEvoy_Michael) call on governments to respect Canadians' quasi-constitutional rights to privacy and access to information. #bcpoli #cdnfoi #coronavirus #stateofemergency #righttoknow ImageImage
Here is the full resolution. But is it too little, too late? @BCInfoPrivacy has given @jjhorgan @bcndp too much freedom to trample on citizens' #FOIA rights, starting with the temporary March 18, 2020 disclosure holiday. #bcpoli #cdnfoi #coronavirus #stateofemergency ImageImage
Today's statement from information and privacy commissioners comes MORE THAN A YEAR after Canadian COVID-19 Accountability group, including @seanmholman, sounded the alarm.
The statutory watchdogs waited more than a year to speak as one. #bcpoli #cdnfoi

ICYMI: Nice work by @TheAusInstitute highlighting an increasing lack of #transparency in the Federal Budget with greater resorting to NFP "not for publication" references to keep info secret. This #secrecy cancer just keeps growing. #auspol #righttoknow tai.org.au/content/new-an…
. @TheAusInstitute highlights a few NFP examples including the costs of managing an abandoned oil rig formerly owned by Woodside; money for the controversial Inland Rail project and expenditure relating to Australia’s Export Finance and Insurance Corporation. All are secret.
There may be valid reasons for some budget details to be kept confidential, but NFP is resorted to with ever greater frequency. It would be a good thing if @ANAO_Australia were to conduct an audit of NFP decisions. But, surprise, surprise, the Auditor’s budget has been cut.

Universal access to information is a cornerstone of healthy and inclusive knowledge societies #AccessToInfoDay #AccessToInfoKE #RightToKnow Image
Universal access to information means that everyone has the right to seek, receive and impart information. This right is an integral part of the right to freedom of expression.
The media plays a crucial role in informing the public about issues of interest, but it relies on the ability to seek and receive information, too. Hence, the right to universal access to information is also bound up with the right to freedom of the press #RightToKnow

#BREAKING In an historic 6-1 decision, the HCA found the @palaceletters should be released to the public following a 6 year legal battle fought by Professor Jenny Hocking for access to historical records about our political history & our #RightToKnow.
#auspol #auslaw
Thread 👇
2. The Court decided the letters were Commonwealth records under the Archives Act, because they were the property of the Cth, namely the official establishment of the Governor-General & ordered that Archives reconsider Prof Hocking’s requests for access to the palace letters.
3. HCA held “with respect to the majority in the Full Court, we cannot see how the correspondence could appropriately be described, however "loosely", as "private or personal records of the Governor-General" even allowing for ambiguity of the description of "private or personal"

This piece from 2011 by Jay Rosen is really interesting in light of attitude of many punter to many News Corp journos losing job yesterday.

I see many journalists blaming punters or treating them with disdain for not supporting them, maybe look at why? abc.net.au/news/2011-08-3…
We really do need journalists. The average person doesn't have same access to find out what Government is doing.

Journalists need support of people when under siege from a government that does not want any accountability or transparency and makes their job impossible to do.
Yelling at punters for not supporting them or not caring about their #RightToKnow or #FreedomOfThePress campaigns just increases the amount of people who have disdain for the profession and worse, increases the lack of trust.

Labor strongly welcomes the High Court’s decision that the Australian Federal Police raid on the home of journalist @annikasmethurst was unlawful.

This is humiliating rebuff for the Morrison Govt and its continuing assault on the freedom of the press.

abc.net.au/news/2020-04-1…
.@ScottMorrisonMP shrugged off the raids on Ms Smethurst’s home saying, "It never troubles me that our laws are being upheld."

Today the High Court has unanimously made clear that our laws were not being upheld- the PM should be deeply troubled by that. sbs.com.au/news/our-laws-…
Unlike the Morrison Government, Labor believes in freedom of the press and the public’s #RightToKnow.

Labor believes journalists should never face the prospect of being charged, or even jailed, just for doing their jobs.

They shouldn't be having their personal homes raided.

At Senate #Estimates, the AFP confirmed they did not interview either @AngusTaylorMP or @CloverMoore during their investigation into Mr Taylor’s use of doctored documents to launch a political attack against Ms Moore.

There is a LONG list of unanswered #taylorgate questions🧵👇
1. Did the AFP determine if the documents are a forgery?

2. Who doctored the documents?

3. Who downloaded the documents?
4. When were the docs were downloaded, including resolving conflicting dates from @AngusTaylorMP, whose office claimed to the @dailytelegraph that the documents were downloaded on 6 Sept but who said in a subsequent public statement that the documents were “accessed” on 9 Sept?

"I'll take that on notice."
"Again I'm going to take that on notice."
"I think I need to take that on notice."
"I'm not sure. I'll have to take it on notice."

I'm asking a lot of questions about @AngusTaylorMP's doctored document saga in #estimates and not getting a lot of answers... #righttoknow #auspol

This is a taste of what we're being told 👇
Question: Commissioner, do you know who downloaded the document Minister Taylor relied on to cite the incorrect costs in the City of Sydney’s Annual Report?

AFP Commissioner: I personally don’t know, no.

Question: Did the AFP reach a conclusion?

AFP Commissioner: Again I think we’ve been very clear on our process, on the letter, the decision that’s been made...

Thread: off the back of the #righttoknow campaign I’d like to spill some tea about how utterly broken Australia’s freedom of information laws are by using some examples I’ve encountered in my FOI work around My Health Record, the amyl ban & sniffer dogs in Vic
Example 1: the ADHA (agency in charge of MHR) collected data on everyone in the country. Exactly what kind/how much? Collected how? The relevant legislation at the time had about two sentences authorising the ADHA to do this and it was *extremely vague*
Over several months I sent in numerous requests to the ADHA media and FOI teams about how this collection operated. They alternately told me that the request was unreasonable bc it identified hundreds of documents but also because no such documents existed

“This review is not me and I am not aware of it”

The panic that spread through the Department of Home Affairs when @AmyRemeikis at the @GuardianAus asked three simple questions about a $7 million strategic review.

A thread 🧵👇🏻

theguardian.com/australia-news…
The strategic review of the Dept of Home Affairs was announced by then-Treasurer @ScottMorrisonMP in the 2018 Budget only 5 months after @PeterDutton_MP’s mega-Dept was created.

$7 million of taxpayers’ money (your $) was set aside for the review because you can’t “set & forget”
Back in July, @AmyRemeikis at the @GuardianAus sought a copy of the completed the review.

The Department said the review was completed but the report was not publicly released.
