VICTORY: In a momentous win for the family of Anthony Huber—one of two men killed by Kyle Rittenhouse—a federal judge today rejected arguments from Defendants—including Kyle #Rittenhouse and the City and County of #Kenosha—moving the case closer to a jury trial. Thread:
Today, a federal judge ruled in favor Anthony Huber’s family in a civil rights lawsuit against the City of Kenosha and Kenosha police officers that seeks to hold the law-enforcement officers responsible for their role in the events leading to Anthony Huber’s death.
In August 2021, Anthony Huber's family filed a constitutional civil rights lawsuit in federal court against the Kenosha Police for their role in Rittenhouse’s deadly rampage that left the Hubers’ son, Anthony, dead. Kenosha Police took sides during the peaceful protest...

If you want to understand why #Fetterman is unqualified for any legislative office, here’s an example. I am quite tweeting a thread I posted during the #Rittenhouse case, just after the gun charges were dismissed explaining the judge’s reasoning 1/
2/ it takes a lot of twists and turns to explain why the judge was right to say Kyle Rittenhouse could lawfully possess an AR-15 when he was technically 17 years old.

but whether you agree with the judge or not hear some thing all of us can agree on:
3/ this statute is very badly written.

If the Wisconsin legislature was trying to say that a 17-year-old could not carry long guns in public, they screwed it up. And if they were trying to allow 17-year-olds to carry such guns, they did a poor job of saying that, too

Funny about Shapiro, @brithume and other non-Trump GOPs/Cons is this: They KNOW that national media shape the conversation from #Rittenhouse to #WaukeshaAttack, yet they think if only Trump tweeted this/that way, all would be good for him.

Total lala land disconnect.
“We don’t know the motive of the mass murderer,” writer Shapiro.

He calls him a murderer so at a minimum Ben admits that murder was a motive.

Yet he writes we don’t know the motive.

“Do Not Comply” Ben plays with one hand behind his back when it comes to politics of politics.
I didn’t monitor his Twitter account at the time, but did Shapiro say this 🔺 on Rittenhouse within days of the shooting last year? I’m not asking this as a trolling question. I’m asking if any of you out there remember how he went about it at the time.

A few days ago, @DennyBurk posted this picture of an @MSNBC legal analyst with the book #CriticalRaceTheory: The Key Writings in the background.

Given the pushback, I thought I'd show how CRT can help us understand progressive commentary on the #Rittenhouse verdict. A thread: 1/
CRT asserts that racism is "ordinary, not aberrational." It is the "usual way society does business" (Delgado and Stefancic, CRT: An Introduction, p. 8).
This is especially true in our legal system, where ideas like "liberalism, neutrality, objectivity, colorblindness, and meritocracy… camouflage [how] racial advantage propels the self-interests, power, and privileges of the dominant group" (Harper et al., JHE, 2009)

The handwringing we're seeing now by liberals to the hard-left over the #Rittenhouse verdict demonstrate they want street militants on their side to be able to physically beat or kill their victims without consequence. "Heroes."
Those complaining loudest now over the Rittenhouse verdict had nothing to say when the criminal justice system (both local & federal) systemically failed to hold violent left-wing rioters & criminals accountable for their actions last year. Most of the cases weren't even pursued.
Even if you don't fight back during a politically-motivated beating by the left, you'll always be framed as the aggressor who deserved it, or someone who lied about injuries. Some on the left have an expectation it is a duty for you to die. They feel indignance at your existence.

To the people upset today about the #RittenhouseVerdict let me suggest that you consider a possibility: are you sure you are right?

You base your perception of the case on certain facts. But are you certain those “facts” are actually true?

Thread
Lawyers learn to ask themselves constantly “how do I know this? And is my source of information correct?” Try that exercise for every fact you believe to be true.

For instance, you often hear that #KyleRittenhouse brought a gun across state lines.
Except there isn’t a scintilla of evidence that he did so. A Wisconsin resident stated that he gave him the gun after he arrived in Kenosha.

Sometimes a fact can also be true and distorted. You hear a constant drumbeat of “he crossed state lines.”

A better tomorrow is not possible if white supremacists are allowed to kill today.
A just future will not come if the arms of justice are slathered in the supremacist codings of the past.
The burdens of dirty deeds thought done & past linger in the smoke trails of a burning barrel lovingly cradle by a white boy fostered to fear black liberation.

The #Rittenhouse verdict does not come as a surprise - but in conjunction with the reactions on the Right, it reveals a lot about this country and our current political moment, and none of it bodes well for the future of democracy.

My main takeaway - a thread:
A country defined by a political and social culture - characterized by white nationalism, gun fundamentalism, toxic masculinity, and glorified militancy - that is bound to produce many iterations of Kyle Rittenhouse…
A country in which the Right quickly unifies behind not only defending, but glorifying Rittenhouse’s actions…

There's so many emotionally driven "hot takes" regarding the #RittenhouseVerdict As a trial attorney, unless I'm in the room, I respect the jury's verdict. May not like or agree with it, but they were the ones who heard ALL the evidence. KR was able to afford a proper defense.1/
He was able to raise over $500k due to the publicity of the case. Most ppl are unable to do that. There are hundreds, both white & POC alike, of ppl who are force to take bad plea deals or are wrongly convicted bc they had an overwhelmed public defender who was unable to pay 2/
enough attention to their matter. Most ppl live paycheck to paycheck. They can be easily victimized by a judicial system that doesn't have enough time to address their particular circumstances. A good "paid" attorney can compel the system to do just that and make it more 3/

Seeing a lot on here about the “precedent” set in the #Rittenhouse verdict but I think that is the wrong way to look at it. This is a STATE case and in the state of WI, you can claim self defense even if you started the fight, which isn’t the case in many other states. 1/
He may have been convicted on at least some charges in most other states with more competent prosecutors, less biased judge and less generous statutes with regard to self defense. 2/
Also in most other states (or even in most other WI courtrooms) the weapons charge would not have been dismissed. 3/

Good morning from #Kenosha

It is the 14th day of the #RittenhouseTrial … and the third day for jury deliberations

The front steps of the courthouse are empty for now.
Per @mtarm with the AP, a court official said the jurors have begun deliberations for the day.

They were behind closed doors for nearly 9 hours Monday (with a lunch break) and nearly 8 hours yesterday. #RittenhouseTrial
Yesterday -- jurors asked to see several videos in evidence, including drone video that has now become part of two motions for a mistrial.

The #Rittenhouse defense said it didn't know it had a lesser quality version until last Friday.

wait... the prosecutor put the drone footage on a thumb drive to send to the state crime lab but didn't think that's how he should provide it to the defense?? WTF? Now he's blaming the software on Ms. Wisco's phone?! This is disturbing. #Rittenhouse
The defense doesn't have an obligation to ask you for the drone video on a thumb drive or compact disk or floppy disk, Mr. Prosecutor! You have an obligation to give them the EXACT EVIDENCE you received - and the way you do that is a portable storage device and checking file size
I love that the captioning on Law & Crime translates ADA Binger as 88 Banger

.@EdMorrissey, you should always read my feed.

1. The judge knows this case is crap.

Most of this is Opinion, but I think it’s a reasonable one.

2. It is harder for the state to challenge a verdict of acquittal than a granted motion for mistrial

(Cont)
3. If it’s overturned on appeal, the state would get to try #Rittenhouse all over again. That might be their goal all along.

4. So he’s waiting to see if he gets anything but an acquittal. Even a hung jury might not make him happy

Also…
5. They just filed the motion yesterday. The judge might give the prosecution more time to respond to it because we are no longer a trial.

all this was clear as day to me. No mystery at all

The #Rittenhouse case goes to the jury today. It probably won't come back today; regardless, I just want to put some of my thoughts out there for the world today anyhow. A small thread.
2/ I did not watch every second of every day of the trial. But I tried to follow along with good reporters and smart commentators. Most of what I see is skepticism that Rittenhouse will spend even one more day in jail.
3/ We can argue--and people have!--about whether that is the fault of the ADA pushing back against pre-trial rulings, a possibly-racist judge who doesn't know how any technology newer than a slide rule works, the general zeitgeist, whatever.
