There was a chance the Supreme Court would either save *or* kill the #ACA this morning as part of several decisions announced...but the #TexasFoldEm case turned out not to be among those.

That means the ACA will likely survive at least until sometime this spring/summer. 2/
The good news is this means Congress still has time to #MootTheSuit. There's three possible ways to resolve the issue before SCOTUS issues their decision:

1. ā¬†ļø the penalty to $1 or more
2. Clarify that the mandate can beāœ‚ļø
3. āŒ the mandate language itself

I've tried to patiently explain that M4All would also include an individual mandate penalty. It's called "pay your fucking taxes or you get busted by the IRS."
Irony: As terrible as the GOP's ACA "replacement" plans were, THEY STILL HAD AN INDIVIDUAL MANDATE PENALTY of one sort or another.

One added a 30% premium surcharge for a full year if you went without coverage & wanted it back. Another added a 6-month lockout period.
Of course, when every one of their replacement plans failed, what was the one thing they *did* eliminate? The ACA's mandate penalty.

Result? Unsubsudized premiums jumped around $580/year per individual market enrollee. Not nearly as much as expected, but not chump change either.

The @HouseDemocrats, @SenateDems, @JoeBiden & @KamalaHarris can #MootTheSuit and #SaveTheACA by passing any one of the following 3 simple, 1-paragraph bills:

1. ā¬†ļø the mandate penalty above $0
2. Clarify that the mandate can be āœ‚ļø
3. āŒ the mandate language itself
In the House, any could be done easily.

In the Senate, the 1st could be done via budget reconciliation; the 2nd or 3rd would need 50 votes+VP w/no filibuster *or* 60 with it.

It could be easily tacked onto a larger bill...but that bill would have to be passed & signed QUICKLY.

Republicans have tried and failed to repeal the ACA at least 70 times in Congress and twice through the courts, but as was heard in todayā€™s oral arguments, the Supreme Court must be deferential to Congressā€™s intent and uphold the law.
If the Trump-GOP lawsuit is successful, more than 20 million Americans could lose their health care coverage, 130 million Americans with pre-existing conditions could lose protections, and drug costs could skyrocket for seniors.
Democrats believe this lawsuit has no merit, and we will continue to fight to make coverage more affordable and accessible for all Americans. #SaveTheACA

By forcing the removal of the #PublicOption from the outset, there was no low-cost plan that commercial insurers would have to compete against. Read - they charge more #mypremiumsarehigh
By denying constituents #MedicaidExpansion, governors and state legislatures forced people to go w/o insurance and screenings (out of spite) In fact, they would have qualified for free Medicaid and coverage. They yelled, "See how hight your premiums are!" But go ahead, blame #ACA

One judge is a Jimmy Carter appointee.

As @mattbc just noted, while a HUGE social media presence to #SaveTheACA is expected (as well as real world protests/rallies, etc), the sad truth is that there's very little which can be done to influence the 5th Circuit panels' decision. They're lifetime judicial appointees. 2/
As he also pointed out, while the *hearing* will happen on Tuesday, they likely won't announce their *decision* on the case for several weeks or even months...and the odds are that their decision will then be appealed to the U.S. Supreme Court regardless of how they rule. 3/
