Last night the Supreme Court rejected Republicans’ attempt to overturn the election results in 4 key states on the grounds that Texas had no standing

What does standing mean?

Standing asks whether the party bringing the lawsuit even has the right to sue.

It basically requires that the plaintiffs have real injuries caused by defendants that can be addressed by the courts.

Technically, standing has 3 requirements:

1.Injury in fact: A imminent or actual concrete injury that affects plaintiff in a way it doesn't affect everyone else

2.Causation: The injury has to be traceable to defendant

3.Redressability: The court must be able to fix the injury

The GOP defense of Trump during the impeachment was that it was too close to an election to remove the president: The people should decide.

Now 17 GOP-led states want a pretext to throw out the election.

Sad conclusion: A great many Americans still don't want democracy.

Notice that I said "still."

A great many Americans didn't want democracy during the Civil War. Slavery was decidedly undemocratic.

A great many Americans didn't want democracy during Jim Crow when African-Americans were lynched for trying to vote. That wasn't democratic.

A great many Americans didn't want democracy when the Fifteenth Amendment was passed and women were deliberately omitted. Denying the vote to women was not democratic.

Democracy scares people.
They prefer power concentrated in the hands of people who look like them.

(Thread) How did the #TexasLawSuit go off the rails?

Let me count the ways.

First, given the allegations, the remedy is [to say the least] inappropriate. The better word is "insane."

The allegations are that:
2/ In other words, the allegation is that state election officials violated equal protection and usurped the power of state legislatures to make rules.

There is no accusation that any voters committed fraud.

The complaint is in how the states carried out their elections.
3/ The remedy sought is to disenfranchise every single voter—not only in those states but in the entire country—which is what would happen if those four states were thrown to the Republicans.

Even if the allegations were true, this is an absurd remedy.
