Okay, maybe you’ve seen me posting about why US lawyers at the southern border should be collecting evidence that MX lawyers can use to challenge the gov of MX (GOM) facilitation of US border policies in MX courts. Here’s my best attempt at a thread explaining why.
First, US courts aren’t saving us. This isn’t surprising, and I’m not suggesting that we abandon litigation in the US. Just acknowledge that US court litigation isn't a panacea.
Meanwhile, advocates in MX have challenged GOM’s facilitation of US border policies in MX, and they’ve had some real success. For example: imumi.org/2022/11/24/org…

#BREAKING @CBP reports 233,740 migrants were encountered along the southern border in November alone-- 2,466 more than October. These are the highest numbers reported for November on record.

Of the 233,740 encounters—13,150 were unaccompanied minors— Compared to 12,024 in October.

66,984 migrants were expelled under #Title42 — There were more expulsions in October with fewer encounters according to @CBP

Title 42 is still in limbo and may end December 27th.

TX: #BREAKING Several Border Patrol agents in the Del Rio Sector tell me they have been directed to process migrants from El Salvador, Guatemala & Honduras under #Title8 (expedited removal unless they have a credible fear) and to stop processing them under #Title42

#Title42 is the @CDCgov health code set to end May 23rd. These countries are “northern triangle countries”—migrants from there would typically be expelled under T42.

DHS sources tell me under #Title8 Many migrants are placed in ICE custody & transferred to a holding facility.
Sources tell me this will be the process while there is space, then migrants will be released on “notice to appear.” Meanwhile, hundreds of single adult men and women are released daily on parole, something I have witnessed in both Brownsville and San Antonio.

#BREAKING Gov. @GregAbbott_TX announces all illegal immigrants that come into the state of Texas will be put on charter buses to the steps of the U.S. Capitol in Washington D.C.— TX Dept of Emergency Mgmt says it will charter as many buses necessary to carry out governor’s order.
Additionally, starting this afternoon @TxDPS will be stationed at the 28 crossings into Texas to conduct enhanced vehicle checks in an attempt to thwart drug/human smuggling and also cut down on pursuits— It’s part of @GregAbbott_TX expansion of #OperationLoneStar
Governor @GregAbbott_TX also announced all @TxDPS and specially trained @TXMilitary will be equipped with riot gear along the border as a precaution following violent videos coming from caravans in Mexico.

Today @POTUS and @SecMayorkas issued their guidance to reimplement (and expand!!!) the Migrant Protection Protocols (MPP) - a deadly program that violates the human rights of asylum-seekers every day it exists. A🧵on what this means and how it's really really bad.
Time and time again @DHSgov and @POTUS have affirmed that #MPP is an unworkable program with "endemic flaws, imposed unjustifiable human costs" that "fails to provide the fair process and humanitarian protections that individuals deserve under the law." This is true.
.@DHSgov claims that due to a Texas court decision that #MPP must be re-implemented, their hands are tied. But despite their changes to supposedly make the program less-inhumane, the new guidance actually EXPANDS #MPP

What’s the role of the US government in the Central American migration crisis? Arguably a very powerful, defining role and one that continues to drive inequality and violence in the #GlobalSouth.
In March 2020, Border Patrol reported 172k unauthorized migrants from C. America & Mexico, a 70% increase from Feb & a 20-year record high. Spikes in migration happen every 2 to 3 years and often go unaddressed: fam.ag/3jktU1p
Economic and political turmoil, gender and gang violence, climate change & corruption have been factors driving #migration in the region for years. Today, the effects of Covid-19 are yet another reason why people are leaving in search of more security and stability.

Let's look at the facts. The right to seek asylum is protected in the US not only under international law through the 1951 Refugee Convention, but also domestic law. Congress codified this when it passed the Refugee Act of 1980. (2/9)
The Trump Admin used a 1944 health code called #Title42 to circumvent the law under the guise of public health concerns. In March of 2020 amid the COVID-19 pandemic, the US started the practice of deporting migrants before they have a chance to file for asylum. (3/9)

We are extremely disappointed in the Biden Administration's decision to appeal the federal court ruling that would block #Title42. @POTUS has a moral obligation to stop using T42 to harm families and children seeking asylum.

Yesterday in McAllen: @CBP overwhelmed. No room to process illegals inside, so have to wait outside under bridge. Just in 24 hrs in 2 stations, encountered over 3,400 (1700 MCS & 1300 RGVS). Currently holding over 7,000 illegals w/ some 5,000 waiting… #BorderCrisis (1/5)
…It’s over 100 degrees. The 2 stations have combined capacity of 620 – holding 7000! From Agent with over 2-1/2 decades of service -  “they are way past capacity – so aliens sit outside because where do you take them? …it’s a nightmare – people want to go to bathroom… (2/5)

We're here to tell you this simply isn't true.

.@ICEgov is saying these facilities will simply become “3 day processing centers” for those given Notices to Appear (a charging doc initiating removal proceedings).

But we've been representing families inside of Karnes for years & can pretty much call BS on this.
For the past 3 years we’ve observed up close countless & frequent policy changes directly impacting the lives of people seeking safety, imprisoned by our gov't.

ICE can resume expedited removal & prolonged detention at any moment.

This is a glaring PR stunt by ICE.
