Smith hadn’t provided prior witness statement so prosecutors asked for continuance to next week to prepare, otherwise they'd be going in blind

Tory’s lawyer George Mgdesyan tells us: “He did not ask for immunity & did not say she was the shooter”

As for why defense didn’t agree to continuance: “We believe we have more than enough and we are afraid with the holidays we will lose jurors and it will result in a mistrial,” Mgdesyan says, confirming @JamesQueally report
