Mutual Legal Assistance Treaties (MLATs) allow for the exchange of evidence and information in criminal and related matters. In money laundering cases, they can be extremely useful as a means of obtaining banking and other financial records from our treaty partners
There are a total of 20 Articles in the Treaty. Several of which shall be highlighted here. (To read them all see PDF link above)
Article 1 sets forth a NON-EXCLUSIVE list of the major types of assistance to be provided under the Treaty.
2 (b) Providing documents, records, and OTHER ITEMS
Article 2 defines the Central Authorities as the Ukrainian Prosecutor General and United States Attorney General who will communicate directly with one another.
Article 4 prescribes the form and content of written requests under the Treaty, specifying in detail the information required in each request. The article permits other forms of requests in emergency situations but requires written confirmation within ten days (or more as agreed)
Article 5 requires the Ukraine to execute the request promptly and do everything in their power to execute the request and keep it confidential.
Article 8 provides that a person in the Ukraine from whom testimony or evidence is requested shall be compelled, if necessary, to appear and testify or produce items, documents and records. Also allows U.S. prosecutor(s) to question witness.
Article 9 requires the Ukraine to provide official records in possession of the government.
Article 13 requires the Ukraine to use its best efforts to ascertain the location or identity of persons or items specified in a request
Article 15 obligates the Ukraine to execute requests for search, seizure, and delivery of ANY ITEM to the United States.
The President of the United States is bound by the Constitution to enforce the laws enacted by the legislative branch. The law is to be enforced regardless of the political party of the law breaker or if he or she is running for office.
