A certain crispness in the air...

Autumn leaves of crimson and gold...

Why, it must be time for the Fall 2019 Unified Regulatory Agenda! 1/

reginfo.gov/public/do/eAge…

There's an increasing number of legal #immigration regulations in the pipeline, even as the clock is ticking more loudly:

7 regs finalized (3 blocked or delayed)
7 near-final
>24 pre-proposal

There is no way that this can all get done this term. 2/

The administration knows it only has 14 more months of guaranteed time in office.

The true hard deadline for final regs isn't Jan. 20, 2020—it's Dec. 20, 2019 (enough time for an effective date 30 days later).

For a proposed reg? Oct. 20, 2019, latest. Assuming warp speed. 3/

DHS, DOJ, & State already have a ton of unfinished #immigration regulations on their plate, as I outlined 6 months ago. 4/

So what's new this time around?

Biggest deal for US businesses: Changes to "Optional Practical Training" (OPT) are back on the agenda.

OPT is how many int'l students stay in the US after graduation for up to 3 years of training. Gateway to H-1B visa. 5/

Also of concern for US businesses:

Changes to the L-1 visa, which allows transferring an employee from an office abroad to a US office. Alternative to the H-1B visa. The administration is not a fan. 6/

Potentially a big deal for international travelers: @CBP wants to tighten up eligibility for business travel & tourist visas (B-1/B-2).

(This isn't technically a new plan, but I didn't notice it last time...) 7/

@CBP Biggest deal for family-based #immigration:

New hurdles for US family members who want to sponsor a relative for a green card.

This is part of the same "invisible wall" trend we've seen with the #PublicCharge rule, healthcare mandate, fee rule, etc. 8/

@CBP Looming obstacles for vulnerable people:

Constraining discretionary work permits & parole:

Expanding "unlawful presence" for all temporary visa holder:

Tougher rules for victims of crime (U visas):

9/

@CBP Plus a whole bunch of new constraints on #AsylumSeekers, with more detail from @SarahPierceEsq @MigrationPolicy here: 10/

@CBP @SarahPierceEsq @MigrationPolicy This regulatory agenda is aspirational; it's not a set of hard deadlines. That said, the *third* #PublicCharge rule (this time from DOJ) may be getting close to the head of the line. And it's bound to terrify millions of lawful permanent residents. 11/

@CBP @SarahPierceEsq @MigrationPolicy For almost a year, OMB has been sitting on a USCIS proposed rule to eliminate work permits for spouses of H-1B workers. There's a courtroom drama unfolding, too. 12/

@CBP @SarahPierceEsq @MigrationPolicy With new leadership at main DHS & USCIS, plus increasingly loud table-pounding from the White House, it's hard to predict which of these rules will get prioritized.

I guarantee that many will get rushed through, but that even more will languish. 13/13
