On January 3, we filed FOIA requests seeking the legal and policy justifications for and any communications with Congress about the military strike on Qassem Soleimani
Today we filed suit to enforce these FOIA requests. @sorendayton said: “Under our Constitution, the President doesn’t get to decide by himself to put the country on a path to war. Congress also has a role in decisions about whether the U.S. takes military action.”
As the Senate considers the war powers resolution by @timkaine @SenMikeLee and others, it is critical that American people and the Senate have the full facts. We are filing for a preliminary injunction to get those facts immediately.
After the 2017 bombing in Syria we filed a similar FOIA and a lawsuit. In that case, a federal judge explained that when the American people are “closed off from such a debate,” this is “itself a harm in an open democracy.”
On January 9, the House voted on a bipartisan basis on @ElissaSlotkin’s resolution to limit the President from taking us to war in Iran. This is a step in the right direction for Congress toward taking back the power over life and death.
