1/6 @LindseyGrahamSC's #EARNIT Act would give AG Barr a blank check—via #Section230—to crack down on Internet services, effectively ban secure #encryption & impose other de facto mandates that could never get through Congress as legislation
Could be worse than #FOSTASESTA!
2/6 AG Barr could use Graham’s bill to force Apple to give law enforcement a backdoor on iMessage, iCloud or even iPhones—effectively banning end-to-end encryption
3/6 #Section230 has never shielded child porn (CSAM) traffickers from federal prosecution, but Graham's bill would create vast new legal liability for websites—then use that liability to force them to do whatever the AG commands
4/6 The only truly secure communications service is one where only you and whoever you’re communicating with can see the communications — end-to-end #encryption. Graham seems to be targeting those services
5/6 Two critical points:
1) Graham’s “expert commission” is a sham. The AG can establish whatever “best practices” he wants as #Section230 conditions
2) Those need not be directly related to child porn—so could include backdoors or age verification mandates
6/6 Remember, Backpage's operators were prosecuted and pled guilty under before #FOSTASESTA took effect. #Section230 didn't stop that.
Likewise, DOJ can already prosecute website operators for failing to cooperate with law enforcement in stopping child porn trafficking
