1/9 What happens if the #ElectoralCollege vote is a tie? Here is a website that lists 64 different ways that could happen:

If there is a tie then we might wind up with President Biden and Trump’s running mate as Vice President.

2/9 In case of #ElectoralCollege tie the 12th Amendment says the House elects the President with each state getting *one* vote and the Senate elects the Vice President with all 100 Senators voting. Link to 12th amendment:

3/9 Since a majority of Senators are Rs the senate would quickly vote in favor of Trump’s running mate to be Vice President. Boom! That’s a done deal.

4/9 Now let’s look at the House electing the President. Currently there are 23 states where a majority of House members are Ds, 26 states with an R majority and PA is tied. If the House votes in November, then Trump would get a second term.

5/9 But the 12th Amendment sure seems to give the House until March 4, 2021 to make this vote. If as a result of the election the new House has 26 or more states where a majority of House members are Ds, then the House would elect Biden as President.

6/9 Per the 20th Amendment Trump’s term of office ends January 20, 2021. Assume several House races have not yet been certified and the House has not yet voted for President. The R Vice President will be sworn in as President.

7/9 Eventually the House will vote for President (remember: 1 vote per state!) and the R VP will go back to being the VP.

8/9 Now think about how important it is for (1) you to vote and (2) to vote in all the races on your ballot. Whether Biden or Trump is the next President might come down to a *single House race* in some state.

9/9 Think it cannot get any weirder? Ha! Sure it can. As a result of the 2020 election the Senate could easily be split 50/50 between Ds and Rs. And should that happen then the R Vice President (see above) would break any tie votes in favor of the Rs.
