When in a hole...
... it's best to stop digging:
theguardian.com/education/2020…
(Waving shovels around can be a dangerous business...)
The letter @RTaylorOpenData sent to @RoyalStatSoc last Friday (21Aug):
assets.publishing.service.gov.uk/government/upl… selectively quotes from what @RoyalStatSoc said to @StatsRegulation:
...which you can see if you read @RoyalStatSoc's copy of the letter sent on 14 August:
rss.org.uk/RSS/media/News… < note the "But" that @RTaylorOpenData missed off in his letter, and the significant context that precedes RSS' statement that he quotes:
Meanwhile, if you read the text of the disputed #NonDisclosureAgreement:
assets.publishing.service.gov.uk/government/upl… you can see the second part of clause 2.1, plus clause 6, would have *precisely* the legal effect @RoyalStatSoc were concerned about - which @RTaylorOpenData denies in his letter...
...which begs a few questions:
1) Can the Chair of @ofqual not correctly parse a legal agreement? (Which is a sort of #algorithm, after all...)
2) Did he take proper legal advice?
3) Does he believe things mean only what he wants them to mean, not what they actually say?
And here's a [Thread] confirming the above:
and a copy of the letter that @RoyalStatSoc sent to Roger today:
rss.org.uk/RSS/media/News…
Now written up in the @guardian...
theguardian.com/education/2020…
...albeit omitting some of the wider picture:
