When two or more persons agree to do something unlawful, and in the process, something more criminally weighty happens, by the hand of one person, ALL the parties are guilty of the serious crime, even if it was not caused by them directly.

A perfect example will explain the principle, and this is a true story. I will change a few things, jut a few.

4 guys and a lady decided joined a group, which has now been proscribed by the Federal govt. They decided to to “raise” money and equip their office

They planned to rob a guy from another part of the country of his Keke (Tricycle), sell it and use the money for their office.

One of the guys got a local gun, just in case🤷🏼‍♂️. They didn’t plan to use it o, but they just agreed to hold it, “just in case of incasity”

The operation kicked off, but in the process, the guy with the gun, let’s call him Mr. A, was surprised by the victim’s punch and resistance. He instantly pulled the trigger and kills him. The other 3 guys and lady were shocked, they didn’t plan to kill anybody

The plan was just to steal the Keke, sell it and make money to equip their office. Now there is a dead body. They decided to bury it. The lady looked out for passersby while the 4 guys buried the deceased successfully. The Keke was taken to another state and sold

The real owner of the Keke had installed a tracker on it, and after the driver was not found for days and weeks, the Keke was tracked to the Neighbouring State. The new owner was arrested and information about the Sellers were obtained. The 5 of them were all arrested

They were ALL charged with Armed Robbery and Murder. Both capital offences, and attracts the death penalty.

Now, why charge all 5 with murder when only Mr. A carried a gun, and pulled the trigger, without consulting others?

The Law is: Where two or more persons form a common intention to do something unlawful, and in the process, another crime is committed, each of the conspirators is guilty as if he or she pulled the trigger.

It is not a defence that you only agreed to do XYZ.

Moral of the story: Just advise yourself and yours. 🤷🏼‍♂️
