THE NECESSITY OF ESTABLISHING JUSTICE AMONG YOUR CHILDREN EVEN IN TERMS OF GIFTS
Shaykh Allahmah Ibn Fawzaan Al-fawzaan (Hafizahullah) was asked with regards to one giving some of his children some gifts and not giving others.
He answered:
As for giving your children anything of wealth, or anything that is seen as a gift, it is compulsory that there should be equality among all the children. It is not permissible to honor part of your children over others, or select some with gifts and deny the others.
This can be seen clearly from the Hadith of the Prophet SallAllahu Alayhi Wasallam, Where he said:
"Fear Allah, and be just among your children."
However, if what you decide to give your children is borne out of individual needs or necessities (one wants to buy this, another
wants something else from what they need in their daily lives), then no doubt that the needs of an elder son would differ from the needs of a younger one or an infant (this one wants to buy a Kaftan to wear, and what another needs is a diapers), then each one would be given what
he or she needs at that material time and they won't be the same. But for a gift, or giving one ownership of a certain asset, equalisation between all your children is compulsory. (For instance you want to give a car to one, you must give it to all. Or you want to give a plot of
land to one, you must give it to all. Unless if you give the car or the house to one for usage while the ownership is still retained by you the father). Else, you have to give all your children that same property or asset, and there is no difference between a male & female child.
The principle of a male child receives double of a female child (as in the distribution of inheritance) doesn't apply here, because it is just a gift. You will give a female child of yours the same even if she is married and living with her husband what you give your male child
even if he is living with you, we long as it is a major gift or ownership of an asset.
This is the justice system in Islam.
