1. Maniammai was neither Periyar’s daughter nor his adopted daughter. She was a fellow comrade in DK, who also looked after the ailing Periyar.

2. Their marriage happened in ‘1948’.
3. There was no provision for a female to be adopted in 1948. Only a male could be adopted under the Brahminic Hindu law.

4. Only after The Hindu Adoptions and Maintenance Act, 1956, adoption of a female was possible. Section 10 of the act deals with the capacity of a child/person (both male and female) to be adopted.

5. So Periyar was unable to adopt Maniammai to ‘Transfer his Property’ in 1948.

6. The Hindu Women’s Right to Property Act 1937 that was in effect at the time of marriage provided only the lawful wife absolute ownership that too with two limitations.

7. If the Hindu law at the time of Marriage i.e, 1948 would have allowed Periyar to adopt a ’Women’, he would have adopted for transferring his estate.
