🚨THREAD: Missouri v. Biden - Brief from the government in appeals case.

We are about to go through some of this brief the government filed. It is their argument to the 5th circuit for why they should overturn the judges ruling in the lower court on the temporary injunction… twitter.com/i/web/status/1…

As per the government, It’s critical that they be able to speak to citizens. Foreign actors may use a crisis to cause distrust in the official word of the government.

Problem? The injunction doesn’t stop the government from doing this AT ALL.

Here, the government is making an argument that they have the right to persuade you about THEIR views.

Again, nothing about the injunction would stop them from “persuading” you. All the injunction does is stop them from saying “hey social media company, take this post we don’t… https://t.co/bamwsmebzbtwitter.com/i/web/status/1…

They say the court ignored that. I say that the government is counting on the 5th not to read any of the materials and just “take their word for it.” It’s utter ridiculous, and thankfully, that isn’t going to happen.

They keep saying that the injunction censors the GOVERNMENTS speech. It’s so disingenuous as to be nauseating. That isn’t what the injunction says at all.

For those who may not have seen, here is the ACTUAL order and what the government is misrepresenting to the 5th.

Here the government argues that all of that discovery we got- all of the talk about “Cognitive infrastructure,” all of the attacks on Facebook from Flaherty, all of the alerts the FBI sent to remove content, all of the threats made both in public and in private were completely… https://t.co/y2G92sIWwwtwitter.com/i/web/status/1…

Here they basically argue that (Beanz speak here) “yea, we did this in the past as the Plaintiffs have shown, but they can’t prove we will do this AGAIN in the future. They can’t prove future harm.”
