Below are a few factual predicts along with a bit of spicy commentary that might be helpful before we crack a few eggs:
-APA is real and Trump has repeatedly lost the argument surrounding the APA
-Arbitrary & Capricious is NOT the same as willfully disregarding Federal Courts
-the APA allows for Judicial Review irrespective of Trump’s lack luster losing arguments

Again I recall sharing with you that several State AGs had already been working (since Nov 2024)
The main argument from the Blue States:
-Trump violated the APA
-specifically the States are requesting Trump’s orders concerning the Dept of Education
-separation of powers
-APA, lack of notice and minimal rationale proffered and even less current legal framework that the Trump Admin consistently fails to meet the basic understanding of separation of powers, appropriations, obligated funding
Trump believes “he can do what ever the fuck he wants and the Roberts Court (history will prove my 2019 assessments that the Roberts Court is the most currupt SCOTUS Court
-Dept Ed’s own internal guidelines FAILED to notify the States that the Dept Ed EMBARGOED MILLIONS of dollars and failed to follow not only Agency CFRs but actual laws
As many of you know (because I’ve repeatedly stated) most State & Local Governments fiscal year July to June. Whereas the Fed Fiscal Year is Oct to Sept. this “staggered” funding has been in place for decades.
This is reiterated throughout the States newly filed Complaint because the Trump Admin literally fucked over EVERY-state in the Union.
“…States according to the formulas set by Congress; the applicable appropriations acts, which require that these funds become available for obligation by the Secretary on July 1, 2025; and ED regulations, which provide that these funds are available for the States to obligate once they are made available to the Secretary. None of the authorizing statutes for these formula grants confer discretion on the Agency Defendants to withhold funding to conduct the discretionary “review”

violation of the Administrative Procedure Act, absolutely zero advance notice. It’s one thing to fuck up a federal appropriations but it’s an entirely different conversation when you are dealing with an unrestrained megalomaniac that truly enjoys being cruel & unreasonable. -The Migrant Education Program, which was created by Congress in response to the 1960 documentary Harvest of Shame to support the education of migrant farm workers .
-Title II-A, which supports recruitment, training, and retention of effective teachers and school leaders, particularly in low-income and underserved communities.
-Title III-A, which provides English learners and immigrant students with the tools they need to attain English proficiency and meet state academic standards.
-Title IV-A, which supports student well-being and academic enrichment through services like school-based mental health care, violence, bullying, and suicide prevention, arts and STEM education, and college and career guidance.
-Title IV-B, known as the 21st Century Community Learning Centers Program, which funds after-school and summer programs, tutoring, mentoring, and expanded literacy services.
-Adult Education Grants, which help adults build literacy and job-readiness skills, including civics education for English learners.”

I do think the plaintiffs filed a robust & factual arguments but I genuinely am concerned that SCOTUS’ recent shitty ruling gave Trump even MORE POWER
Honestly it would not surprise me if Trump (because his an obese intellectual midget) will argue “SCOTUS game me more power and now I can dismantle yet another Federal Agency Congress created & billions of appropriations
