Kushner/Brookfield bailout update, Flynn edition:
@WendySiegelman (linked here) and I have been two of the people focusing the closest on the Brookfield bailout of Kushner 666 5th Ave.
Beyond Qatar's link, why would Brookfield bail out Kushner?
We are learning more from Flynn. 1/
2/ Last week, Qatar officials were scrambling to @reuters with the utterly disingenuous claim that its bailout of Kushner through Brookfield was "unwitting." I wondered if Qataris knew something was going to break. Maybe it was the Flynn news today?
3/ A timeline, drawing from the House Oversight Report for @RepCummings, linking Flynn, Kushner, Westinghouse, and Brookfield:
"Whistleblowers Raise Grave Concerns w/ Trump Administration’s Efforts to Transfer Sensitive Nuclear Technology to Saudi Arabia"
assets.documentcloud.org/documents/5743…
4/ "Whistleblowers provided new information about IP3 International, a
private company that has assembled a consortium of U.S. companies to build nuclear plants in Saudi Arabia. IP3’s only project to date is the Saudi nuclear plan."
Flynn visited Saudi for IP3 in 2015.
5/ "A key proponent of this nuclear effort was General Michael Flynn, who described himself in filings as an “advisor” to a subsidiary of IP3, IronBridge Group Inc., from June to Dec 2016—at the same time he was serving as Donald Trump’s national security advisor."
6/ "According to whistleblowers, Flynn continued to advocate for the adoption of the IP3 plan during the transition and after he joined the White House..."
Another key proponent of this effort was Thomas Barrack, Trump’s personal friend & Chair of his Inaugural Committee."
7/ "Barrack...opened communications w/ UAE/Saudi, recommended Manafort as campaign manager—and then tried to arrange a
secret meeting between Manafort and MBS.
24% of the $7B raised by Barrack since Trump won the nomination “has come from UAE or Saudi.”
That's almost $2B.
WOW.
8/ "Derek Harvey, Sr Director for Middle East at the National Security Council stated during the first week of administration that the decision to adopt IP3’s nuclear plan... to develop “dozens of nuclear power plants” had
already been made by Flynn - while he was advising IP3."
9/ "Career staff warned that any transfer of nuclear technology must comply with the Atomic Energy Act. Harvey..ignored these warnings. One senior political official stated that the proposal was “not a business plan,” but rather “a scheme for these generals to make some money.”
10/ "Days after the inauguration, IP3 officials sent documents directly to Flynn for Trump to approve, including a draft Cabinet Memo stating that Trump had appointed Barrack to implement the plan."
Trump was forced to fire Flynn Feb. 2017, but Harvey maintained contact w/ Flynn.
11/ More than 5 confirm that Harvey stated on March 2, 2017: “I speak with Michael Flynn every night.”
"A career NSC staffer who joined a call with RICK GATES, BARRACK, and Harvey [said Harvey] was trying to promote the IP3 plan 'so that Jared KUSHNER can present it to [Trump]."
12/ Pausing my House report summary w/ a reminder:
On inauguration day, Flynn texted business partners that a plan to build nuclear reactors in Middle East was "good to go."
Because Obama's sanctions would be "ripped up," according to whistleblower.
politico.com/story/2017/12/…
13/ Russia/Saudi/Trump quid pro quo comes into focus:
"The whistleblower said [business partner] gushed that Trump's inauguration was 'the best day of my life' b/c it meant his company's effort to create a U.S.-Russia energy partnership in the Middle East...was moving forward."
14/ March 14, 2017:
Trump met with MBS in Oval Office w/ KUSHNER, “discussed opportunities for U.S. companies to invest in Saudi"... potentially more than $200 billion in investments.
Senior Official 1 stated to NSC staff: “What the hell is going on?”
15/ Then it gets interesting with Westinghouse and Brookfield:
March 17, 2017:
IP3 leaders McFarlane, General Keane, Rear Admiral Hewitt, & General
Alexander signed a letter to MBS on this agreement, referenced a “partnership to acquire WESTINGHOUSE between IP3 and Saudi Arabia."
16/ Westinghouse is a major nuclear power company that is struggling through bankruptcy (filing Ch. 11 in 2017).
Brookfield acquired Westinghouse in Jan 2018.
Brookfield bailed out Kushner in May 2018, closing on 666 5th Ave just before Kushners owed $1.2B balloon payment.
17/ Tellingly, the House Report actually connects these dots between the Flynn/Russia Saudi conspiracy, Brookfield, Kushner, and the 666 bailout in its own timeline. The House Oversight lawyers are on it: h/t @WendySiegelman
18/ "In Feb 2018, it was reported: 'Administration is considering permitting Saudi to enrich and reprocess uranium as part of a deal that would allow Westinghouse and other American companies to build nuclear reactors.”
1 month after Brookfield bought Westinghouse.
19/ Now dig deeper on that Feb 2018 report:
"Administration is mulling whether to ease [regs] as a way to help Westinghouse and other corps win Saudi contracts. Saudi plans to construct 16 nuclear reactors over next 20-25 years at a cost of more than $80B"
bloomberg.com/news/articles/…
20/ Energy Sec Perry pushed Westinghouse on MBS the same month its new owner Brookfield bailed out Kushner:
May 9, 2018, Perry lobbies Saudi "to use Westinghouse to construct its reactors: 'We tried to really drive home to MBS. You have to use Westinghouse.”
Cc: @KarenAttiah
21/ Sept 26, 2018, Sec Perry reportedly stated Saudi "recently made a decision that keeps U.S. businesses—foremost Westinghouse Electric Co.—in the mix for what could ultimately become a market worth tens of billions.”
"FOREMOST WESTINGHOUSE."
(And foremost Brookfield/Kushner?)
22/ The bombshell takeaway is huge:
The House Oversight Committee is showing it has the goods from whistleblowers potentially to connect
FLYNN 🔥
⬇️
Russia/Saudi/UAE nuclear/sanctions conspiracy
⬇️
Westinghouse
⬇️
Brookfield
⬇️
KUSHNER
💥
23/ Now review the dots I was connecting a year ago from the Steele Dossier, Rosneft, and Kushner pushing a military blockade by Saudi/UAE against Qatar in 2017, followed by a $184M loan by Qatar-backed Apollo, and then his 666 Brookfield bailout:

Remarkably, @baseballcrank's defense of Ilya Shapiro's anti-identitarian tweets...
plays the identity card.
Ilya's anti-affirmative action stems from his family's experience of anti-Semitism.
So race & ethnic lived experience are relevant to judgment, eh?
nationalreview.com/corner/the-dis…
2) I'm not sure what @baseballcrank is trying to say with this word salad.
I think it's a non-sequitur play of the Russian Jew identity card.
Is some logical connection between the different parts of the sentence? I wouldn't want to assume so, b/c that could be stereotyping.
3) Here's @baseballcrank playing the Russian-Jew ethnic card a second time.
I'm glad we agree that race, ethnicity, family & lived experience & empathy are all relevant to interpreting law:

Yesterday I got cursed & ratio'ed for this tweet. Now Day 2 starts with a new round of blue-check-marks making the same point that vaccination is not like abortion.
Here are two thoughts:
1) Yes, I know.
Legal arguments can turn on finding common principles in dissimilar cases;
2) My goal was to build a legal argument building on one 6-3 SCOTUS decision on vaccine mandates into a case to save Roe.
I acknowledge I am being naive about the conservative Justices. But I was naive to suggest consensus or common ground or moderation or nuance on Twitter.
3/ Could I have been more explicit in the first tweet to acknowledge the different stakes? Sure. But even when I clarified in a second tweet, the ratio'ing and the nastiness only escalated:

What could Garland do to investigate Trump for January 6th?
IMHO, the only step for Garland is to appoint a special counsel (a Mueller-type).
And I think that's the only way Garland would go, termperamentally.
It says a lot that he hasn't/won't.
1/
law.cornell.edu/cfr/text/28/60…
2/ An investigation into Trump, Biden's once and future political opponent, checks both reg boxes:
a) "conflict of interest...or other extraordinary circumstances; and
(b) That under the circumstances, it would be in the public interest to appoint an outside Special Counsel" Image
3/ Because Garland has not yet appointed a special counsel, he is unlikely to do so. It takes time to find a counsel, assemble a team, then more time for them to get off the ground.
Let's say he had appointed one today. There still isn't enough time left to litigate.

A very merry Christmas to all who celebrate!

(It’s a not-well-kept secret that many traditional-ish Jews not only wrote some of the best Christmas songs, but also love Christmas songs).
It reminds me of a BC time years ago, when a group was trying to set a Guinness record…
1/
2/ (BC = Before Covid)
…for the largest carrolling group ever assembled. I was so excited to participate. I didn’t know the songs very well, and I probably have the worst singing voice of anyone who ever enjoyed singing. Like American-Idol outtakes bad.…
3/ A large group was appealing, so I started practicing a bit…
Then I checked the date: A Saturday afternoon.
Shabbat.
Not walking distance, back when I was trying not to drive on Shabbat…
I said, “Nu, that’s not very inclusive of all the shomer Shabbat carrollers.”

The Royal Prerogative, according to Blackstone, included which of the following:
A prerogative to...

(H/t @ShaniaTwain, @KingBobbyBrown, @jdmortenson)
Hint: The unitary exec theorists misquoted Blackstone to claim one of these.
Somehow, I keep finding evidence to the contrary.
Please tell Roberts, Kavanaugh, and Thomas that originalists are just making stuff up, so maybe they should be less sanctimonious against Roe & privacy.
I love that a wrong answer is in the lead.
I found more evidence in Aylmer, The King’s Servants, including this page.
He says each question was posed as a “yes, obviously”

If Trump wins a second term, I hope people understand how Cy Vance, Eric Schneiderman, Tish James and the corrupt Cuomo NY Democratic Machine enabled him all along the way.
2. Eric Schneiderman was too scared to go after Trump.
Wonder why.
