THREAD: What do today's Supreme Court decisions about Trump's tax returns mean?
1/ Today the Supreme Court issued two opinions regarding Trump's tax returns. The first opinion considered whether he was immune from state court grand jury subpoenas or whether there was a heightened standard for him.

Trump lost that case 7 to 2. Link: supremecourt.gov/opinions/19pdf…
2/ It has long been established that presidents had to comply with *federal* grand jury subpoenas. Trump's attorneys argued that allowing "thousands of local DAs" investigate him would distract him too much from his duties.

The Supreme Court rejected that argument.

1/ It's fair to say that, despite today's rulings, Trump will continue to be able to litigate and "run out the clock" until after the election.

It was hard to imagine a result that would have foreclosed that possibility. Even the Manhattan DA conceded that he could do so.
2/ I understand that most people are focused on the practical effect of these decisions on Trump. But the principles in these decisions matter.

The Supreme Court decided that no president is above the law, concluding that the president must comply with state criminal subpoenas.
3/ The Congressional subpoenas decision is less sweeping, but that was expected, given that Congress is a political body that can use subpoenas as a political tool.

This isn't a dramatic result, but the 7-2 decisions against Trump's absurd arguments are good for the nation. /end

1/ “Structuring” is when you deliberately break down financial transactions until smaller amounts to avoid reporting requirements.

It is a federal crime, but is rarely charged and is usually charged alongside more serious crimes or occasionally in lieu of those crimes.
2/ For example, former House Speaker Dennis Hastert was charged with structuring because prosecutors couldn’t charge him with his child sexual abuse.

Epstein’s attorney should be concerned about his own liability, given that he asked how to evade requirements.
3/ I would not be surprised if SDNY federal prosecutors tried to put pressure on this attorney in order to convince him to cooperate against Epstein’s other associates.

But any cooperation would be complicated by potential attorney-client privilege issues.
