CA Supreme Court
backs greater access
2 police misconduct cases
Case stemmed from lawsuit
filed by L.A. deputies union 2
prevent former Sheriff
Jim McDonnell
from turning over
2 D.A. about 300 names
of deputies
w history of misconduct.
Hence,
today's verdict:
California Supreme Court
decided unanimously Monday
Los Angeles County Sheriff’s Department
+ other law enforcement agencies
may alert prosecutors
a [dirty] deputy
who might testify
in a criminal case
has a history of misconduct. latimes.com/california/sto…
Decision overturns
Crt of Appeal ruling
barring sheriff from giving prosecutors
names of deputies
who had committed misconduct,
including:
▪️lying
▪️taking bribes
▪️tampering w evidence
▪️using unreasonable force
▪️engaging in domestic violence.
Seems 2 hit all the mob areas √
Decision said
merely disclosing 2 prosecutors
deputy was on list of problem officers
did not violate CA law
protecting personnel records.
Prosecutors have
constitutional duty
2 learn of any evidence
favorable 2 defense +
disclose it, crt noted.
Once alerted
deputy has history of misconduct,
prosecutors can file motion
2 obtain deputy’s records.
Judge would then review
officer’s recs in chamber
+ determine if anything
must be disclosed.
If info is potentially exculpatory,
prosecution must disclose it
2 defense.

Senate Bill 1421,
effective 1-1-19
allows public 2 view investigations
of officer shootings📌
+ other major uses of force,📌
in addition 2

+ lying while on duty. 📌
Another bill signed N2 law last yr
requires law enforcement depts statewide
2 make public body-worn camera video
+ audio recordings
of officer shootings
+ serious uses of force
within 45 days,
unless doing so would compromise
an ongoing investigation.
An LA Times investigation
