1/ The Republican Party is different now. During the Nixon era, the parties had not completed their platform shift.

For example, much of the GOP was still white and southern.

During the past few decades, the GOP has shifted from a conservative to a reactionary party . . .

A trial with Nixon era conservatives will pay out differently from a trial with reactionaries.
3/ Consider the timeline with the Nixon impeachment.

In July, 1973, Nixon refused to hand over the tapes.
Nov 1, 1973 Jaworski was appointed as new special prosecutor.
Early in 1974, Nixon folks started pleading guilty to crimes.
April: Jaworski subpoenaed the tapes. . .

June 15: All the President's Men was published.
July , 24: Nixon was ordered to hand over the tapes; House moves too impeach.
August 8: Nixon resigned.

As soon as the truth came out, Nixon was cooked.

Because the truth still mattered to the Republican Party.

In fact, right wing media was born to protect future Nixons.

Manafort, Roger Stone, etc, were the extremists in the Nixon GOP. They didn't want Nixon to resign.
6/ The extremists have now taken over the party, and they've boldly adopted fascist techniques to torpedo truth and undermine factuality.

During the Nixon era, everyone basically got their news from the same places.

What sociologists call the "public sphere" was still intact.

That's why people say polarization is the greatest problem were have and tearing apart democracy.

In the Nixon era, we shared a common truth.
Now there are two separate versions.
7/ Trump has never bothered with a traditional legal defense.

You can't devise a legal defense while you're obstructing the proceedings, because you can't devise a legal defense while you are breaking the law.

Trump intends to defend himself by torpedoing truth and factuality.
8/ If a jury convicts him, he'll say, "They were Democrats out to get me."

He'll be a victim. He'll be a martyr.

He and the GOP will continue to undermine the results of any investigations. Look at their FISA circus.

I can't see him resigning the way Nixon did.
9/ For one thing, Nixon could retire to his estate.

Trump can't. His "estate" is under siege from law enforcement.
The Manhattan DA is after him.

And that's just for starters.
10/ He really has no choice but to hold onto his office and keep swinging.

I have no doubt that in the end, democracy will prevail—because we have numbers on our side.

Even with all the cheating and voter suppression in 2018, the Democrats won by 8 percentage points.
11/ A lot of people are working hard now to fight the cheating. Just look at Georgia.

Democracy will prevail if there is an outpouring in 2020 sweeping the corrupt GOP from office.

But I think it's naive to believe that a Trump impeachment will play out the way Nixon's did.

Trump lost in court THREE MORE TIMES today.

Trump tried to get all three of these cases⤵️ dismissed and lost. I analyzed one of the cases last April, Blassingame, here: (Transcript on my blog.)

He tends not to do well in court, where facts matter.

Um . . . this isn't the defense Trump thinks it is.

Trump published a letter he received from Mazars dated (it looks like) 2014. He then summarized the letter.

#1: What Mazars said
#2: What Trump says Mazars said

Me = 🤦‍♀️

Does he think nobody can or will actually read it?
Mazars said, "Trump is responsible for preparing the financial statement."

Also Mazars does not "undertake to obtain or provide any assurance that there are no material modifications that should be made . . . "
Trump posts the letter and says Mazars "strongly states that all work was performed in accordance with professional standards and that there were "no material discrepancies in the financial statements."

There is no "I don't know how to read" defense.

For this week’s blog post, I edited and combined a few of my recent threads.

I started with a reading of the newly unredacted sections of the Mueller report, then talked about some of the responses on Twitter . . .

. . . and concluded with thoughts about how social media brings out authoritarian instincts in large swaths of people who ordinarily would not be given to authoritarian impulses.



It's too easy for truth to lose, and when truth loses, democracy loses.
Right. And not all "manipulators" are bad actors, but all people need to learn to evaluate sources.

Reflectively saying, "Professor X should know" is not how to do it. It takes more work. Falling in line is always easier than doing the work.

I'm tired of the word "accountable." It's a weasel word. Don't say "accountable." Say what you mean.

Does "accountable" mean
🔹Lose elections?
🔹Go to prison?
🔹Lose a lawsuit?
🔹Be hated?

It would be nice if all the good people were rewarded and the bad people punished.
So you want to start indicting people and gather the evidence after they're indicted?

Or not worry about evidence?

There are rules of evidence, which means that the stuff you've read in newspapers and Tweets probably isn't admissible in court . . .
Indicting people and having juries return "not guilty" verdicts because there isn't evidence to prove each element of a crime beyond a reasonable doubt may not accomplish what people think it will accomplish.

One reason I think social media is turning everyone into authoritarians: people don't read or think.

They see a headline and have a strong emotional reaction, which they Tweet and which then gets repeated by others, who are also not thinking . . .

Political psychologists like @karen_stenner describe the authoritarian personality.

Those with an authoritarian disposition are averse to complexity. They reject nuance.

They prefer sameness and uniformity and have “cognitive limitations.”
