Rauch Wise now giving the defense closing arguments.
Wise saying there is only circumstantial evidence in this case. Says if there is a reasonable possibility they have to find Lewis not guilty.
Wise says if anyone had a right hand person who was female it would be normal to tell everyone else not to have relations with her because she had sensitive information. Says this was not a sinister thing to do.
Wise says the receipt was a mistake. Says someone who was checking the bills should have caught that. Also mentioning the alleged call to Ty Miller on the way back to Greenville.
Wise says no one would have questioned Lewis going to the national sheriff's school in Reno. Says even though it's not absolutely necessary it would be something that would benefit doing the job at hand.
"Let's talk about the case in the way it should be looked at" says Wise. Says Lewis saw how Nabors did work at the law firm and knew she could handle the assistant job. Says a moral lapse is not sufficient to convict. Says that is not misconduct in office.
Wise says if your administrative assistant started budget research you would want them at a budget meeting. Says Lewis wanted to make drastic changes and wanted someone to be supportive of that and that's why he brought Nabors.
Wise says if Lewis wanted to take a trip to have sex with Nabors he wouldn't have brought along other people.
Wise calling Nabors' testimony dramatic and like the worst thing that ever happened to her. He's now reading the transcript of a recording saying it didn't sound like that when Lewis asked her to go to Reno.
"Let's talk about who was manipulating who" says Wise. Says when you start recording your boss you are through with your job.
Wise moves onto the text Lewis sent Nabors on the second night in Charlotte. Wise says the state didn't try to get the phone records.
Wise says something happening late at night at a hotel room in Charlotte is not official duty. Says the sheriff has the obligation to follow the law. Says what he did in Charlotte was consensual.
Wise now talking about Sydney Salati's contact info. Says it was in his phone before testimony claims he asked for the contact info later on. Says the texts come from early 2017.
Wise saying sexual harassment is not a crime.
Wise says if you listen to the tapes Nabors never refers back to what happened in Charlotte in a negative way. Wise says it seems to him like Lewis was being manipulated.
