Trump is nominating Judge Justin Walker for the influential DC Circuit — Walker serves as a district judge in Kentucky (he got a "not qualified" rating from the ABA when he was up for that seat) and clerked for Justice Brett Kavanaugh when Kavanaugh was on the DC Circuit

Hello from my living room, where I'll be streaming arguments at 9:30am before the en banc DC Circuit in two blockbuster cases about whether/under what circumstances Congress can take the executive branch to court — the Don McGahn subpoena fight, and a border wall funding dispute.

In the McGahn subpoena fight, a district judge ruled Congress could sue to enforce a subpoena, and she rejected the Trump admin's argument that past/present senior presidential advisers enjoyed "absolute immunity" from being compelled to testify.

SCOTUS won't revisit its decision to let the Trump admin's "public charge" rule take effect while litigation continues challenging it — lawyers for the challengers had asked SCOTUS to reconsider given the pandemic, prev. from @Haleaziz on this: buzzfeednews.com/article/hameda…
Note that SCOTUS says the challengers can go back to the district court to try to raise pandemic-related arguments about why the "public charge" rule should be blocked — so if that happens, this issue could trickle back up again

Last night, a judge approved Facebook's $5B settlement with the US govt to resolve privacy violation claims. The allegations of "unscrupulous" behavior were "stunning," he wrote, and warned if FB doesn't do better, he might not be so deferential next time assets.documentcloud.org/documents/6876…
In cases where there's a consent judgment that a judge has to sign off on, the judge holds on to jurisdiction over the matter. So if, in the future, the govt thinks that Facebook is violating the terms of the agreement, they can come back to court and ask the judge to intervene.
Judge Timothy Kelly (one of the newest judges on the DC federal bench, confirmed under Trump), writes that he has some concerns about whether current laws do enough to protect consumer privacy on platforms like Facebook, but "those concerns are largely for Congress"
