A Florida law firm, Berman Law Group representing healthcare workers in the US sues China for USD 6 trillion. I will walk you through the firm, the parties involved and the merits(if any) of their case so that we can hopefully put a stop to the madness.

BLG is a boutoque local firm with a focus on personal injury litigation. A typical "ambulance chaser" set up. Their founder Russell Berman is not recognized by any industry publications like Legal 500 or Chambers etc bermanlawgroup.com
The management of the firm consists of Joe Biden's brother , Francis Biden, who is a not a qualified attorney, his role in the firm is unknown. The subject case is led by Jeremy Atlers, another non-practicing attorney who also serves as the firm's chief strategist.
Now, moving onto the writ filed at the District Court of Florida, the firm alleges that China owe a duty of care to US HCWs and China by "hoarding" onto PPEs has led to damages caused to the HCWs.
(i) China is a sovereign state and cannot be sued in a domestic court. The firm argues for exemption under Foreign Sovereign Immunities Act which does not apply to acts done outside US soil nor does it apply to policy decision of a government.
(ii) it is impossible to establish a duty of care owed to the plaintiffs, it is simply unforeseeable that keeping masks for the use of her own citizens would cause damage to HCWs thousands of miles away. This is tort law for LLB students.
OK, here is a slew of untruth and imaginative allegations which have been disproved many times over by reputable sources including but not limited to, scientific research. I am not bother to comment on them.
If, and it's a big "if", they manage to overcome all those hurdles aforementioned, they would still need to prove causation, ie, the damages sustained is the result of the action or inaction of China. How about contributory negligence by the US?
And even if that's not an impediment, how do they plan to enforce it? See blow analysis by US attorney which seems on point. I just hope that by this thread, the average Americans are not being used by ruthless law firms for their publicity stunts.

Jeremy Atlers of the Berman Law Group who leads the litigation against China has been disbarred from the Florida Bar 4 misappropriating clients' funds n lying abt his tax status. Why this was not disclosed on his bio I would nvr know.

Misappropriation of client's funds is equivalent to theft. I wish to highlight this to further question the credibility of the firm and the merits of the case. How they appoint a disbarred dishonest lawyer to head the case is beyond me. Maybe @thejeremyalters can add some colours
