Oh dear, another 'clarification'/correction letter from the
Foreign and Commonwealth Office's Sir Simon Macdonald after his appearance before the Foreign Affairs Committee on Tuesday, this time relating to Harry Dunn /1
This is a transcript of his evidence on the Harry Dunn case. I have highlighted the parts which he has corrected, which is pretty much all of it /2 committees.parliament.uk/download/file/…
He now clarifies (with transcript for comparison):
1. "All parties involved... operate within accepted framework of operational independence of the police it being for them to determine what steps to take in the investigation of criminal offences"
2. "in my evidence I stated that in the Dunn case there was a conversation between lawyers in Washington and London on immunity. This is not correct. Legal teams in Washington and London considered the issues separately" -
3. "All parties are also aware that while the FCO can provide assistance on questions of immunity, and in particular on relevant questions of fact, questions of law under the VCDR are ultimately for the courts (as indeed are all questions of law)"
To be clear, I am acting for Harry's parents in the ongoing Judicial Review claim against the Foreign Office
