Truly important @UKSupremeCourt judgment this morning on when it breaches a person's human right not to be inhumanly treated to send them back a state where they will have no access to life-saving medical treatment

There has been a long and very sad series of cases where a person is going to die because they are sent back to a country where they won't be able to access essential medical treatment. This appellant is HIV positive and wouldn't have access to appropriate treatment

Supreme Court confirmed it would follow a recent-ish decision of European Court of Human Rights Grand Chamber which lowered the test from "reached such a critical stage that it would be inhuman to deprive him of the care he was receiving and to send him to an early death"...

... to substantial grounds for believing A, while not at imminent risk of dying, would face real risk in receiving country of being exposed either to a serious, rapid & irreversible decline in health resulting in intense suffering, or to a significant reduction in life expectancy

This is the new test - note Supreme Court did not stop the deportation, it required him to now go back to a lower court to submit evidence that he meets the test.

Note also the revision of Court of Appeal's reasoning (and lowering the threshold) which will probably save lives

The upshot is that this judgment will undoubtedly save lives and prevent removals where someone is suffering from a serious medical condition. Well done Zane Malik
