This is really bugging me. One of the reasons why the guidance from @PHE_uk mustn't be conditioned by the available supply of PPE is that health care workers must have the right to choose whether to bear the huge risks of caring for patients without adequate protection.
It is really difficult for - especially junior - Doctors and nurses to say "I can't subject myself to that level of risk" if advice that "only low-level PPE is available" is missold as advice that "low-level PPE is adequate".
The reality is that there isn't the right PPE. Suing isn't going to conjure up more - and that's why @GoodLawProject won't bring those cases. Families who have lost breadwinners must be compensated but that also won't magick up PPE. But there is a problem that can be solved today
If fair advice is given about proper levels of PPE, health care workers can make choices about whether to expose themselves to risk. Those choices are really hard for caring professionals - but they belong to those professionals. Quite wrong to deny them the chance to choose.
