[4/5] The Const is an instrument of enum powers. Powers not granted the Fed are denied. There’s no constitutional basis for the Fed Govt to conduct intell against U.S. citizens. The legislation creating the Intell Community defines intelligence strictly as “Foreign Intell.”
[5/5] The standard for collecting agnst foreign operatives in nat sec is much lower than for U.S. citizens. Providing Intell data on Americans to other agencies can circumvent Const Rights guaranteed in the Bill of Rights. Privatizing the collection effort circumvents even that.
