1 Closure of TASMAC shops – Political Stunt or Undue Mileage by MakkalNeedhiMaiam @maiamofficial @ikamalhaasan @Indumakalktchi It is widely reported that Kamal Hasan’s MNM obtained orders from Madras High Court for closing TASMAC shops. The court order tells a different story
2. As per newspaper Reports, MNM filed WP No.7599 of 2020 and Mr.ARL Sundaresan, Senior Counsel appeared for it. The Order in its cause title mentions specifically two miscellaneous petitions filed by TASMAC and one Mr. G Rajesh in two separate Writ Petitions filed by them.
3. And captured the prayers sought for in the said two petitions. It tagged about 8 other WPs including the one of MNM. Prayers of any of these 8 WPs were not mentioned. The order captures the counsel appearing for the petitioners in all these 8 tagged cases along with
4. counsel for TASMAC and Mr. G Rajesh. In its earlier order, HC permitted reopening of TASMAC shops subject to certain conditions such as production of Aadhar cards, maintenance of social distancing, online sale etc. Against this, TASMAC approached the HC seeking relaxation of
5. these conditions and Mr.Rajesh, approached for closure of TASMAC shops. These two miscellaneous petitions were tagged along with other petitions including the petition filed by MNM.
6. The order dated 8.5.2020 closing the TASMAC shop, was a common order passed in the WMP seeking relaxation by TASMAC and the WMP for closure of TASMAC shops by Mr.G.Rajesh.
7. As a matter of practice, whenever a senior counsel is appearing in a matter, the HC will record the appearance of senior counsel and his arguments, irrespective of the fact whether he is appearing in the main petition or other tagged petitions. But, surprisingly,
8. the name of MNM is nowhere mentioned in the body of the order. The order closing TASMAC shops has nowhere captured in its body (except in the beginning where the counsel for all the petitioners were mentioned) that senior counsel MR.ARL Sundaresan appeared before the
9. bench and advanced such and such an argument for MNM. Interestingly, the main order captured the name of an intervener in the TASMAC petition, and his argument i.e. his readiness to help TASMAC in its online sale of liquour.
