Today, the Pueblo County Sheriff’s Office Dive Rescue Team searched water sites in the area where Suzanne went missing, according to the Chaffee County Sheriff's Office.

This morning, CBI says they, along with the FBI, will return to Salida to continue their search and investigation in the #SuzanneMorphew case.

CBI says no new developments overnight. No arrests as of 7:14 p.m. yesterday, according to the sheriff’s office.
New from the Chaffee County Sheriff's Office just now: The search along County Road 105 in Salida has concluded and despite searching multiple areas on the property, investigators did not make any connections to the #SuzanneMorphew case.
Details about this search are unavailable, the sheriff said. But he said somebody has a key piece of evidence.

“I’m asking our community members to continue to use the tip line (719- 312-7530) to provide any information, no matter how inconsequential the tip may seem,” he said.

Just had a quick conversation with the spokeswoman of the Colorado Bureau of Investigation.

As of now, #SuzanneMorphew has not been found and there are no arrests in this case, she said.
While there aren't any new developments to announce as of now, the CBI spokeswoman acknowledged it's been a while since the sheriff's office shared a news release. She said she'd reach out today to see if they would do that. We'll keep an eye out. #SuzanneMorphew
Today marks one month since #SuzanneMorphew was reported missing.

It's fair to say that authorities involved in this case have been quiet in past weeks, but it's untrue to equate that to lack of an investigation. This is still very much an active case.

Tomorrow marks two months since #SuzanneMorphew went missing. The sheriff's office said investigators have done several searches and followed up on hundreds of tips. More than 600 tips called into the tip line.

Investigators at the local, state, and federal level returned to the Morphew property (west of Salida) today to search the area again for any information, the sheriff's office said.
Chaffee Co. Sheriff Spezze says: “This case remains very active, as more than a dozen investigators are aggressively working this case on a daily basis. And until we determine what happened to Suzanne, we can’t discount any scenario or formally eliminate anyone from suspicion.”

The Chaffee County Sheriff's Office and CBI say they want to support the search efforts that #SuzanneMorphew's brother, Andrew Moorman, is organizing starting Sept. 24. However, they're not able to lead the search "due to liability issues."
Sheriff's office/CBI will instead staff its command post with liaisons to help search volunteers. Crime scene teams will be available should volunteers discover evidence.

"We once again appreciate the Moorman search effort and its many volunteers," the sheriff's office said.

NEW: The Chaffee County Sheriff's Office just reported that "contrary to some media reports, there have been no remains found in the #SuzanneMorphew case."

There have, however, been a "handful of potential leads," the sheriff's office said. So far, nothing connected to the case.

The sheriff's office said the search that Andy Moorman (#SuzanneMorphew's brother) organized has ended.

Authorities collected several pieces of "possible evidence" from the search teams and are still working to determine if they have a connection to the case. Nothing as of now.
Few interesting points from the sheriff's office ⬇️

Authorities responded to reports of dogs indicating the scent of human remains at 3 properties in the county (none owned by Morphew family).

First was along the Arkansas River. But it wasn't a viable lead, authorities said.
Second was near the Morphew home. CBI, FBI and the sheriff's office responded to this one. It was investigated "extensively," but no evidence was found.

Third was near Salida. FBI and CBI responded and excavated this location, but nothing was found in relation to the case.
“While the public may not see all of the effort being put forth in this case, I can assure the community that this investigation continues to move forward," Sheriff John Spezze said in the update. #SuzanneMorphew

Authorities are investigating human remains found on two properties near the town of Lasauses (or La Sauses?) in Conejos County (San Luis Valley). CBI says this does not appear to be connected to the #SuzanneMorphew case, but all possibilities are being considered as of now.
CBI said the town name is Las Sauces, but it also appears as La Sauses, Lasauses, Los Sauces and Los Sauses.

Either way, it's a very small town west of the Rio Grande and south of Alamosa and Blanca. We'll keep an eye on it in case it becomes connected to the case.
Update: Chris Schaefer with CBI said the remains are not in any way connected to the case of #SuzanneMorphew.

“We have absolutely no indication whatsoever that these two cases are connected. ... Sadly, Morphew is not the only missing person from southern Colorado.”

The Chaffee County Sheriff's Office has started a press conference regarding an update on the #SuzanneMorphew case. Suzanne's husband, Barry Morphew, was arrested earlier today on a murder charge.

Chaffee County Sheriff John Spezze: I have learned Suzanne loved her two daughters and she had a passion for life and lived it to its fullest. She was easy to like and cherished by her close friends.
Spezze: Barry Morphew was arrested at 9:15 a.m. today in Poncha Springs without incident. He was alone at the time.
Spezze: Authorities executed more than 135 search warrants and interviewed 400+ people in several states. More than 1,400 tips were submitted to authorities.

"Today is not the day for celebration nor does it mark the end of the investigation," he said.
DA Linda Stanley: This investigation is ongoing and Suzanne's body has not been found. Barry Morphew is presumed innocent until he is proven guilty. His arrest affidavit is sealed. #Suzannemorphew
Stanley: Law enforcement has been working tirelessly on this case, even as they were raked over the coals and their abilities were second-guessed. They followed every lead and never compromised the integrity of the investigation.
Stanley: I wouldn't bring these charges unless I was confident in this case, even if Suzanne's body has not been found.
Spezze, when asked if authorities believe #SuzanneMorphew is alive: "Well, we believe that she's not alive. We've filed first-degree murder charges — or are in the process of filing first-degree murder charges — so our belief is that Suzanne is not alive at this time."
Stanley says Barry Morphew's next appearance in court is scheduled for tomorrow — Thursday, May 6 — at 10:30 a.m. It's his advisement for any arguments on his bond.
Spezze says they don't expect to make any other arrests in connection to the #SuzanneMorphew case as of now.
Stanley: There is no alleged cause of death as of now. But authorities have information about a certain scenario that they believe occurred. But no further comment on that for now.

Per CoCourts, new charges have been announced against #BarryMorphew:
-Forgery of a public record
-Elections-mail ballot offense

Both offense dates are listed as Oct. 22, 2020.

His arrest affidavit in connection to the #SuzanneMorphew case could be released as early as today.

According to new docs just released by CoCourts, #BarryMorphew is now also accused of tampering with a deceased body between May 9-10, 2020 and possession of a dangerous weapon (ID'ed as short rifle). These are both new charges.
The docs also confirm that he's accused of murdering #SuzanneMorphew between May 9-10, 2020.

It names the eight public servants he allegedly attempted to influence.

The first witness called is Chaffee County Sheriff’s Office Cmdr. Alexander Walker. He's detailing the day Suzanne was reported missing (May 10, 2020).
Walker says deputies located a bicycle near County Road 225 and Highway 50. The bike was not damaged, he said, and there were no skid marks or blood on the road or anywhere at the scene. Body camera video of this discovery is playing in court. #suzannemorphew
The body camera footage shows deputies yelling Suzanne's name as they search in rough terrain. They find the bike in thick aspen and fir trees on a steep hill. There is not a visible trail in the immediate areas.
In the body camera video, deputies are talking about how the bike ended up in this area.

In court, Barry is sitting up straight and watching the video.
Walker said the last activity on Suzanne’s phone was from 4:23 a.m. on May 10, 2020. It connected to the cell tower in Poncha Springs.

Morphew daughter's boyfriend told authorities Suzanne would never ride her bike up that trail because it was a "crazy climb."
In another body camera video, deputies ask the boyfriend if Suzanne and Barry had problems. He says they've had some problems in the past, but called it normal husband-and-wife-type stuff.
In another body cam video, Barry Morphew is emotional and seen talking with deputies. He's heard saying Suzanne bikes every day and was asleep when he left the home that day.

In court, Barry's mother and daughters are watching this video. One daughter is blinking away tears.
In the video, Barry is heard asking if deputies saw any "cats" on the road and a deputy says not recently.

Suzanne's turquoise helmet was found a few days after her bike was discovered, Walker says. #suzannemorphew
A selfie Suzanne took from the morning of May 10, 2020 is now being shown in court. She's wearing that helmet.

It was found 0.84 miles from the bike. It was not damaged, Walker said. It had normal wear and tear. Contact info for Suzanne and her daughter was stuck on the inside.
Walker says he spoke with Barry the following day (May 11) at 1:06 p.m.

Barry said the last time he saw #SuzanneMorphew was May 10 at 5 a.m. He said they had had a great day and evening. He said she was "his angel" since they were 17 and they "love each other to death."
Barry said he texted #SuzanneMorphew on the morning of May 10 to say happy Mother's Day, but didn't get a response. He said his daughters said they hadn't heard from her either when they reached out.
Waker said Barry did not call police during this time, and told authorities Suzanne was new to mountain biking.

Barry told deputies on May 11 that a mountain lion attack was possible. He said his worst scare would be "someone picking her up" or foul play at the RV park.
The defense is now cross-examining Walker.

Walker says the arrest affidavit is 129 pages. He said they started writing it on May 11, 2020.
Defense attorney Dru Nielsen said it's not unusual for Suzanne not to reply because they had bad cell service at the home.

Barry told deputies there's "not a more special, wonderful person in the world" than Suzanne, and admitted "they had spats" about him working too much.
Barry also told deputies he didn't like medication she was taking and wanted her to get off of it.

During their arguments, he said "it wasn't like they didn't make up."
Barry didn't protest when the house was a crime scene and when his truck was picked up. He said, "You're welcome to it."

He said Suzanne had been cleaning the house. One of the daughter's bed sheets were stripped. Both daughters were on a road trip at the time.
Nielsen asks if investigators found Suzanne's blood in daughter's room where the sheets were stripped because the floor is carpet.

Walker said no. He confirmed Suzanne's blood was not found anywhere in the house or in the entire investigation. #suzannemorphew
Walker says this is the largest coordinated law enforcement effort he has been a part of. He said the investigation has taken "thousands and thousands" of hours with ~70 law enforcement officers involved and many scientists.
Nielsen describes the many aspects and resources used in the searches: drones, aircraft, scuba divers, pond searches, K9s, mines, ground-penetrating radars, etc.

There were multiple excavations. Suzanne's body/remains have not been found.

Walker says there is still work to be done: "It's a work in progress. I can't say we've searched everything."

Nielsen says investigators found no evidence suggesting Barry was in the house after he left it on May 10 until that evening when he returned with officers.
Nielsen said Barry was with LE to point out Suzanne's clothing — only there for a minute or two. Body camera footage shows he did what they asked. He wasn't allowed back in until authorities finished searching the home.

Suzanne got a spy pen because she suspected #BarryMorphew was having an affair. Walker said there was no evidence of that.

When asked, Walker confirmed #SuzanneMorphew had been having a two-year affair with a man named "Jeff."
Authorities didn't learn about this affair until November 2020 — 6 months after Suzanne went missing. His name is Jeff Libler, Nielsen said. There were hundreds of hours of phone calls, WhatsApp and other communication. They met up at least 6x & she didn't tell anybody about him.
Jeff Libler did not voluntarily come forward to help find Suzanne, Walker confirmed.

LE first spoke with him on Nov. 13, 2020.
Court is now taking a break.
There seems to be some confusion over how this data works (Walker says he's not an expert with this specific kind of data), but this is the prosecution's theory ⬇️
On May 9, 2020, the home's surveillance system was not operating.

During a search of the home, investigators found some cords were missing from a DVR player. Barry said he never touched the system. Once found, they were swabbed and Barry was excluded.
The DVR player is associated with the camera for the surveillance system on the home.

There was strong support for the inclusion of Suzanne in the DNA testing of the cords.
Moving onto Barry's and Suzanne's vehicles.

DNA in the glove box of Suzanne's Range Rover came back with a profile of an unknown male, later confirmed not to be Barry's.
In a redirect with DA Stanley, she asks Walker a few questions:
-Did #BarryMorphew ever call 911?
-Did he report #SuzanneMorphew missing to LE?
-Did he help in any LE-led searches?

Walkers answers no to each.
Stanley asks if Walker, in an interview with Barry on May 11, ever asked him where his guns were. Walker says yes — Barry told him they were in a safe.

Walker said he also found a gun in a closet and shotgun against a wall.
Walker confirms that Barry said he left the home at 5 a.m. for Broomfield.

Stanley confirmed through Walker that data in Barry's truck showed door "activity" at 3:26 a.m.
Walker is done with his testimony.

We're now onto the second witness: Kenneth Harris, one of two FBI Special Agents on the case.

DA Jeff Lindsey will lead this questioning.

Harris says in some conversations picked up on the spy pen, you can hear Suzanne and Barry arguing about money. She's heard accusing him of telling her what she can do & wear.

Another recorded conversation is 5 hours long with Jeff.
While listening to the 5-hour recording, investigators realized the man — later ID'ed as Jeff Libler — was having an affair with Suzanne.
A friend of Suzanne's, Sheila, said while she'd heard from one of the daughters that Barry had described May 9 as a "perfect night," she knew the couple hadn't had a "perfect night in a year and a half."

Suzanne said her cancer had returned in May 2018 and her health was declining. She worried her marriage was only worsening it. Sheila responded, saying the toll of their fights was concerning.

Court is back in session.
FBI Special Agent Kenneth Harris is still on the stand.
Harris said Barry would bring his and Suzanne's daughters into conversation during arguments and blame Suzanne. In these instances she lost respect for him, Harris said.

One of the daughters saw the fighting and said a divorce was a solution to her parents' problems.
Harris said at one point, Barry put a gun to Suzanne's head and asked, "Is this what you want?"

He had also pinned her to the bed. She threatened to call police, Harris said. He added Barry was worried about how others saw their marriage & wanted "to come out looking good."
Harris said in both 2019 and 2020, Suzanne wanted to get out of the marriage, but also wanted to wait until one of the daughters was out of the house.
Harris said Suzanne wished that Barry would find somebody else and leave her.

Suzanne and her good friend, Sheila Oliver, started texting more about Suzanne leaving Barry starting in early February 2020, Harris said.

They're talking almost every day around this point.
Suzanne texted Sheila saying, "My heart aches for them in different ways," about their daughters. The women also texted about Barry having narcissistic tendencies.
Harris said Suzanne was racked with guilt and wanted forgiveness from God. In texts, she said she wondered what the "young me" was thinking. Her relationship with her daughters was the center of her world, Harris said.
Harris is now talking about how Suzanne and Jeff Libler knew each other.

They both went to high school in Indiana and in the summer of 1989, he went to a party at Suzanne's house when Barry was not there and the two hooked up.
Jeff said he got a text from Suzanne saying, "Howdy, stranger" and the two started talking again — about her cancer, books, music, etc. It became more than a platonic relationship. They met in New Orleans in Feb 2019 and fooled around in a hotel but did not have sex, Harris said.
They met up a few other times in 2019 too. Barry became suspicious, so the two started communicating via LinkedIn and WhatsApp.
In interviews after Suzanne's disappearance, Libler said her marriage was not good and had lots of arguments. She said many times she wanted to leave and be married to Libler.
When he learned Suzanne had disappeared and saw news reports of a possible abduction, Libler got rid of his accounts because he believed the affair would be negative for her daughters.

He said not even Sheila knew about the affair.
Libler said he often helped Suzanne find trails for mountain biking.

Harris said Suzanne told Libler that she couldn't get a divorce from Barry for Biblical reasons.
Defense attorney Iris Eytan will now lead a cross-examination of Special Agent Harris.
Eytan questions the agent's interpretation of the texts between Suzanne and Sheila. Harris said the interpretation stems from what Sheila said they meant.
Eytan said Suzanne had a lot of secrets, saying the affair was not a one-night or two-month fling, but rather 2 years.

Harris said the affair was 1.5 years, not 2. A commander with Chafee County said 2 years earlier today ⬇️ so it's not clear.
Eytan continues, saying Suzanne did not tell her sister or best friends about the affair, and never mentioned a male friend to anybody.
Harris said Barry told the FBI he did not know about the affair. Barry said he thought there may have been an emotional one, but not a physical one.
Eytan asked Harris if Suzanne told Sheila that she wanted a spy pen to record Barry in late January/early February 2020.

Harris said he didn't recall.

Sheila got a spy pen — looks like an everyday black pen — and gave it to Suzanne when they were both in Florida. There were multiple audio files on the pen. It activates when it hears a voice, Eytan said. Eleven files were deleted (2 were recovered) and 11 were saved.
Messages between Suzanne and Libler are being read in court. They are sweet messages back and forth:
-"Your heart, that's what I crave"
-"I love how you love me. I love how you think."
-"You're the sweetest thing I've ever known."
An interview with Libler and authorities is being played in court.

He said after Suzanne went missing, he deleted his accounts because he didn't want her legacy to be that she had an affair.
Libler's daughter saw his phone and the communications with Suzanne. She told a few of her family members.
It appears we're having connection issues with our reporter in the courtroom.
I believe we're back up and running again.

In 2019, Suzanne saw Libler twice and they traveled around the county.

Defense attorney Eytan said in February 2020, Suzanne went to see her dad in Florida. Libler was with her at the time for a "secret rendezvous," Eytan said.
Eytan said Jeff and Suzanne were calling each other the love of each other's lives. She took up mtn biking for him.

By April, they were talking about being husband and wife. Libler said he didn't know if Suzanne was joking or not, and didn't know if that was possible for them.
On May 8, Jeff said, "You need to be my wife" and complemented Suzanne's biking gear.

On the morning of May 9, 2020 — a day before Suzanne disappeared — she texted Jeff saying, "We need to be husband & wife."
The last text Jeff Libler sent to Suzanne was on May 9: "My gang is home."

He told Harris he wanted to support Suzanne being on her own, whether they ended up together or not.
The two also discussed moving to Ecuador ⬇️
Libler said the affair made him nervous and he didn't want to lose his job or his family. He said he didn't want Suzanne's legacy to be that she had an affair "with that guy."

Today is day three of #BarryMorphew's four-day preliminary hearing. He faces charges of first-degree murder, tampering with a deceased human body and more. #SuzanneMorphew

Court has started with a continuation of the cross-examination of retired FBI Agent Jonny Grusin by Defense Attorney Dru Nielsen.

Nielsen asks about the five trash runs Barry allegedly made on Mother's Day 2020. (Prosecution brought this up previously: bit.ly/3B2OUA5)
Grusin confirms Barry threw away "junk" at first stop in Broomfield, which was at a bus stop. There are no photos/videos of Barry here. There are visible cameras.
Second stop was at a hotel. Grusin confirms Barry said he was waiting for somebody to let him in so he could get a free breakfast. The exit/entrance to the hotel has trash can near it. Barry never said he threw trash away here, Grusin confirms.
Third stop: Barry said he was getting trash out of his truck at a McDonald's, but didn't eat there. Surveillance footage captured him throwing away trash here (first time we actually see him throw away anything), Nielsen says.
Barry said he is a "tightwad" and doesn't want to pay to throw out trash.

He allegedly said, "I work so much that my truck becomes a trash truck and when I finally get a moment to throw some things away, I do that."
Fourth stop was a Men's Warehouse. Barry said to his knowledge, he didn't take anything to a dumpster there. There are no photos/videos from here of him throwing anything out, Grusin confirms.
Fifth stop came after Barry had gone to his worksite, Nielsen says. He is seen slowly walking across a parking lot at a Holiday Inn past several visible surveillance cameras & signs about them. Enhanced photos show he threw out some items including a plastic tree pot.
They're going over calls Barry made from his car and comparing Cellebrite PDF report to BERLA (records car data).

His phone could have synced with his car if he was in a hotel and close enough to the vehicle, defense says.
Nielsen brings up photo of a tranquilizer dart cap found in the dryer on May 19. Barry said he was not sure how long it had been there and it had nothing to do with him.

Court briefly discussed that calling it a tranquilizer dart "cap," wasn't totally accurate.
Nielsen asks Grusin: You can't say how long that cap had been in there?

Grusin says, "Correct." Barry was excluded with DNA from that cap.

Some empty vessels of the darts were found in the garage. A tranquilizer gun also in the garage did not work. There were no other darts found inside/outside the Morphew home, Nielsen said.
Now going to May 6, 2020.

This was the day Suzanne said her relationship with Barry was "done." She met with neighbor Jeanne Ritter for coffee 9-11 a.m. Ritter said Suzanne seemed "energetic" and "excited."
Now going over some texts and calls between Suzanne and Barry on May 7 & 8.

May 8: Suzanne's phone received a notice about a Facebook reset code. She friended multiple men that night.

Defense brings up a few texts between Barry & Suzanne, and Suzanne & Jeff Libler from May 9.
Suzanne and Jeff also messaged via LinkedIn, as we learned earlier in this hearing. The last LinkedIn message from Suzanne to him came at 2:07 p.m. May 9, Nielsen said. About 35 min later, Barry arrived home.
Now we're on to the redirect with DA Jeff Lindsey.

May 10 morning: Barry turned left instead of right (right = direction of Salida & Broomfield) on Hwy 50.
Grusing says Barry told him it was b/c he saw elk and wanted to see if they were shedding antlers. Barry said he went to Garfield turnaround and then onto Salida. Barry told Grusing this may have been around 4:30 a.m.
Going left would have taken him in the direction of where Suzanne's helmet was found.
DA Lindsey: A drive from Salida to Broomfield is ~3 hours. Barry's phone was in airplane mode from 10:17 p.m. May 9 - 4:30 a.m. May 10. Is that enough time to dispose of a body if driving from Puma Path to Broomfield?

"It is," Grusing says.
Regarding the trash runs, DA Lindsey confirms the "cap" found in the dryer was a needle sheath.

When asked about the dart, Barry said he shoots deer from his garage/breezeway. He said he last used it April 2020.
Between May 5 and 9, messages were deleted off Barry's phone. Some were not recovered, but the "I'm done" text was retrieved.

Grusing confirms that it is possible Barry was tracking Suzanne. There was an objection to this in court, but judge overruled.
Regarding the needle sheath in the dryer, Barry told Grusing: "It could have been in the wash but it's got nothing to do with me... But see, I hate that because you know that makes me look bad. But if it's leaking from Chaffee Co., it's no wonder ppl in this town hate me."
Grusing is done on the stand for now.

Next up is CBI Agent Derek Graham.
Prosecution brings up photo of Suzanne's helmet.

As discussed in earlier testimonies, Graham says the helmet had some minor scratches. Helmet was found westbound on Highway 50 half a mile west of County Road 225 on south side of hwy. This is btwn Morphew home and Garfield.
In photos of Suzanne's vehicle in the garage, there is a Camelback water bladder, similar to the ones Suzanne would use when she'd go biking. Photos also show her her purse with her ID inside.
Now looking at photos of the house.

Photos of Mallory's bedroom (Morphew daughter) show the bedding was removed. Sheets were in the dryer. Comforter was halfway off the bed.
The spy pen was found in the master bedroom in a box of bras. Exhibit 67 is a photo of the pen.
Now onto the cross-examination with defense attorney Iris Eytan.

Eytan starts with the tire track casings collected below Highway 50, around where Suzanne's helmet was found. Graham confirms tire casings were compared to Barry's truck and 2 Range Rovers. It was not a match.
Also compared DNA on Suzanne's helmet to Barry's DNA. This was also not a match, Graham confirmed.
DA Mark Hurlbert now doing redirect.

Hurlbert confirms with Graham that men's khaki shorts and other clothing were found in the dryer. It matches what Barry was seen wearing May 9 on surveillance video.

Barry Morphew has walked into court in a gray suit. He sat down without looking around. His daughter and family is in the courtroom.

All the info in today's tweets is thanks to @ABC.
The judge hopes to conclude this hearing by 5 p.m. because he also wants to rule on releasing the arrest affidavit.
DA Edwards argues that evidence is sufficient in this case, and in this kind of hearing, bond should be denied based on standard of proof.
DA Lindsey is discussing the set of facts in this case & why that standard has been satisfied.

Going over parts of the case (ex. how Barry said they loved each other "to death," him deleting texts & FBI recovering them, how Suzanne said Barry always wanted to be the victim)
DA Lindsey: "This is not about Suzanne and if she had an affair. This is a domestic violence homicide."
DA Lindsey explains Suzanne's efforts and reasons to try to leave the marriage. He also goes over the timeline (texts, calls, etc.) from the few days leading up to May 10. (We've covered those details in previous stories, so not rehashing here).
DA Lindsey reminds court that Barry was not going to let Suzanne divorce him and how he is an accomplished hunter.

He also brings up the tranquilizer cap, calling it "a pivotal piece of evidence."
DA Lindsey says it's "clear that the crime scene had been staged."

No body, no blood, no damage to Suzanne's bike or helmet. The Camelbak and sunglasses she brings on every ride were in her car, back at home, Lindsey says.
Attorney Sean Connelly is now talking. He's representing Barry Morphew.

"This case is based on supposition — no dead body," he starts. "It is remarkable what we just heard." There is no physical evidence and no eyewitnesses, he continues.

"This case can't go forward."
Connelly says, "Is this evidence clear and strong or even probable? They have argued motive and opportunity. They have not proved this."

Connelly notes that following Suzanne's "I'm done" text, Barry did not respond violently. "There was no domestic violence," he says.
Connelly also says at that time of the year, the ground is frozen but the prosecution claims Barry disposed of Suzanne's body.

"The investigation did not meet the standard, because they were trying to trick Barry into admission," he says.
He goes into 10 reasons why:
1) DNA no dispute
2) Changing narrative with Salida Spa visit
3) Questionable to trust Jeff Libler
4) Shifting story about Suzanne's FB activity
5) No evidence that ties the tranquilizer cap to Barry
6) Room in house smelled like chlorine, but it was above a pool
7) Half a cup of coffee was out
8) Barry cooperated and searched on his own for Suzanne's body.
9) Alleged murder weapon doesn't work
And last one:

10) Says last page of warrant has an "ugly metaphor" that has no basis in fact (we don't know what this is). Calls it "misleading" and "offensive."
Connelly: "In their affidavit, they admit this is supposition. Those are their words — and we agree. It’s all supposition. This is not clear and strong. It is muddy and weak. We ask to end this now or let this man have his constitutional right to bail."
Now back to Judge Murphy .

He says, "I can find probable cause — even where there is no body. This is not a trial. It does not serve as a mini trial. Only to see if there is probable cause that there was a murder and that the defendant might have caused that."
Breaking: The judge says he finds probable cause for the charges of first-degree murder and tampering with a body in the #BarryMorphew murder case.

It will go to trial. #SuzanneMorphew
Judge reviews a few points from the case (previously covered), such as texts between Suzanne and Barry, the bike ride on May 10, Suzanne as a mother, how much she used her phone, her fear of Barry, what we know from May 10, data from Barry's truck, her bike helmet, etc.
Judge notes that Barry has a history of changing statements and some of the discrepancies are small and some are major.

"But it is evidence of untruthfulness," he says.
Jude says there are three scenarios in this case:
1) Barry murdered Suzanne
2) Somebody else murdered Suzanne
3) Suzanne left

He says there is evidence that scenario #2 may have happened.
Judge says proof is not evident, nor is presumption great.

"Bond will be set," he says.

We're breaking. Barry is crying and turns around to look at his daughters, also crying, in the courtroom.

The prosecution is asking for a $10 million bond for Barry, noting multiple people Suzanne knew are concerned for their safety (ex. Jeff Libler, Sheila Oliver, etc.). Also said he's at risk for fleeing.
Defense attorney Iris Eytan says Barry has no criminal history and is a hard-working man.

They asked for "an amount that is reasonable" — a $50,000 cash bond.
Judge says $10 million is too high and $50,000 is too low.

He sets #BarryMorphew's bond for $500,000 cash only.
Judge says Barry must surrender his passport and cannot travel or reside outside of Chaffee County. He will be required to wear an ankle monitor.

He cannot post bond until noon on Monday.
They are now discussing the affidavit. Defense is asking to keep it sealed. Prosecution says most of the information has been released at this point.
Judge: On June 4, I limited access to the affidavit. None of those reasons remain. It is a highly detailed description of law enforcement's efforts. The court was concerned it would harm #BarryMorphew's right to a fair trial.
Breaking: The arrest affidavit for #BarryMorphew will be released by noon on Monday.
