To sum up: the key question here is, in my view, whether Cummings had available any reasonable alternative child care that could have kept him at home.
Preferring to have your child looked after by family is very natural and human. But the Regulations stop all of us doing things that are natural and human. A preference isn’t enough.
It may be that the answer to the key question is that he had no reasonable alternative. But that answer isn’t obvious (Cummings isn’t poor and presumably has good friends near his home) and until supporting detail is provided the question remains live.
