1/ In infosec, we started out as the outsiders, and defended ourselves against others trying to enforce their norms upon us. Now we've become insiders trying to enforce our norms on others.
2/ The mantra "Portscans are not illegal" was from a time when we wanted to do them, and resented people who wanted to stop us from doing them. So we vigorously defended the principle.
3/ Now we are often in the drivers seat. We now have the ability to enforce our norms upon normal IT and networking. We ourselves don't want to browser-portscan because, well, we can't: we don't have websites visited by millions of people.
4/ eBay has perfectly legitimate reasons to portscan from the browser to see if visitors have dangerous services enabled like VNC or RDP.
5/ Conversely, browsers have perfectly legitimate reasons to block such activity, or even label websites that do this as malicious.
6/ Either way, it's for them to figure out -- it's not up to us as a community to attempt to apply our own judgements, which comes often more of politics (hating web companies like eBay) rather than our understanding of the threats.
