It is my privilege to be the counsel for a group of distinguished amici curiae in General Flynn’s case. Last night we filed our brief in support of the Government’s motion to dismiss his case. You can read our brief here: drive.google.com/file/d/1Esf341…

As I know a legal brief can be hard for folks to get through, even a short one at 23 pages, I thought I put together this thread to explain the central points that we're making in the amicus brief. To file this kind of brief, you ask the judge for leave to do so with a motion./1
Before you get that motion granted, you draft the brief and it's an attachment to the motion. You have to explain in the motion why you want to file the motion and basically what you're bringing to the discussion. Our motion is here: drive.google.com/file/d/1C9uXGX… /2
You also have to explain who the amici is. Amici is latin for friend basically. It's an old legal form for people/organizations that aren't parties to a case to help the judge decide a question/bring a perspective from those who might be affected by the case but aren't in it. /3

Some folks are noticing that the docket entry for our brief has been removed. This does NOT mean Judge Sullivan rejected the filing. The Electronic Filing System (ECF) isn’t set up well for amicus briefs in criminal cases. /1
The system made the docket entry look like I represent Gen. Flynn instead of the amici group. I sent a message to the court about this last night when we filed. The clerk is simply correcting the docket. But the motion, brief & other papers are on file with the clerk’s office./2
I’m sure we are not the only amici to have filed with the clerk. And I’m also sure that Judge Sullivan will rule on all the motions for leave to file amicus briefs when he’s ready, including ours. In the meantime, you can read our brief here: 👇🏻/3

Hahahaha. No. Their order is a neon sign that Fokker controls. I have practiced in the DC federal courts for 24 years & my hubs for 45 & this is the 1st time we’ve ever seen the Circuit order a district judge to personally answer a mandamus. /1
And they gave him only until June 1, which is well before the deadlines he set in the trial court. This is fast, decisive action by the Circuit, the subtext of which is plainly that they think the case is going off the rails given their opinion in Fokker. /2
True enough the Circuit hasn’t ruled yet, but the message of this order is loud & clear as to what they think the correct answer is./3
