Uncertainty re regulatory clarification--why would it be "rewriting" for agency to define statutory terms consistent w/ statute? YES it could be rewriting, but not necessarily--and if so 1/
@AndrewCMcCarthy @davidharsanyi 2/ courts will strike. Re the disagreement: If statutorily re-written, no reason it cannot be done narrowly & appropriately. We define child pornography & stalking statutorily, make clear definitions by statute. BUT re the unfair & deceptive practices: THAT is horrible idea!
@AndrewCMcCarthy @davidharsanyi 3/3 I've seen how unfair/deceptive statutes are misused & turned into anything I don't like laws. I'm still thinking all of this through but those are my gut reactions.
