Today the NYPD Police Commissioner praised his employees for their abuse and violence against protestors without reservation. He’s not even pretending to “serve and protect.” To him it’s “us versus them.” This is one of the most dangerous people in America:

If true, the implications of DHS seeking identifying data behind social media accounts that track or criticize ICE go far beyond “speech” and “privacy.”

We’re talking about core constitutional structure — how far the government can go to monitor dissent. Thread:
Start with the obvious: the First Amendment.

Criticizing a federal agency is not a fringe activity. It is protected political speech at the very heart of the Constitution.

Targeting critics is not neutral enforcement. It’s viewpoint-based scrutiny.
But this is also a Fourth Amendment issue.

Bulk requests for names, emails, phone numbers, identifying data tied to online accounts begin to look less like targeted investigation and more like digital fishing expeditions.

That raises serious questions about unreasonable search.

I’ve seen ICE’s exact justification before: turning a moving car into a supposed deadly weapon after the fact. To justify extreme force.

In 2018, as a public defender in Brooklyn, I defended a man charged with attempted assault on that basis.

More:
The officer said he had to “jump out of the way” and could have been killed. Sound familiar?

Fortunately we found surveillance video.

It showed the officer was never in danger—my client pulled away, and as in Minnesota, the officer was safely to the side of the vehicle.
When prosecutors saw the video, they didn’t just dismiss the case.
They indicted the officer for perjury.

He was ultimately convicted and sentenced. Image
